KNOW all men by these presents that I Simon Kingyan of Charleston lower
the County of Washington &c do sell and in consideration of the sum of nine
hundred and fifty five dollars and seventy cents paid to me by Walter Berry of South
and the County of Washington and George St. H. Berry of Charleston lower
and the County of Washington I grant bargain and sell unto the said Walter Berry
and George St. H. Berry their heirs and assigns forever the right property and
land lying for three cents, and the said George St. H. Berry the pay one hundred and twenty
four dollars and twenty cents the Right whenever acknowledge
their said Walter Berry, George St. H. Berry and Simon Kingyan’s Conveyance unto the said Walter Berry
and George St. H. Berry their Heirs and assigns forever a certain piece of Land called
the "Old Home" lying in Charleston lower in the County of Washington containing slant one
Hundred and twenty acres for the same now or ever was or of and hereafter known as (said being)
the Northward part of the House by Simon Kingyan on the Northward bounded by the
Land of Samuel Ward in the County of Washington on the Eastward bounded by the
Land of Samuel Ward in the County of Washington on the Southward bounded by the
Land of Simon Kingyan on the Westward bounded by the
the said land with all its appurtenances.
And I do will that the said Walter Berry and George St. H. Berry renounce the Vine
legacy and whatever may belong to the said Walter Berry and George St. H. Berry
their heirs and assigns to their use and be heirs and assigns of the said Walter Berry
their heirs and assigns the said Conveyance and the said Conveyance with the said Walter
Berry their heirs and assigns the said Heirs and assigns in that I am inquiring void in
of the Conveyance that their heirs from full Indemnification therefore have right
to sell and convey the same to the said Walter Berry and George St. H. Berry the same is turned to
again and that I will warrant and defend the same to the said Walter Berry and George
St. H. Berry their Heirs and assigns forever against the Lawful Claims of
all other Persons.
Provided Nevertheless that if the said Simon Kingyan on the said Simon
Administration etc shall will and fully pay to the said Walter Berry and George 16
the said Berry their Heirs etc together with the full and just sum of
nine hundred and fifty five dollars and seventy cents and on a further
sum of January Next which unless he do deliver on or before the first day of January
1828 the full amount for the same until the then said Deed shall be void whereas
said shall remain in full force and virtue as witnessed whereof I have set my seal
my hand and seal this fifth day of January in the year of our Lord one
thousand eight hundred and twenty eight 1828

1828 in done affirmed the appearance of Simon Kingyan signed above
his name and the said Simon Kingyan acknowledged the same to be his free Voluntary
Deed of sale and did Read and signed the same

Whereas Walter Berry and George St. H. Berry late of Charleston lower in the Above manner
gazer in Company and on the date herein aforesaid were held by said Walter Berry and
Samuel Ward that is to say in the aforesaid Composition of Nine Hundred and fifty five
Dollars and seventy cents paid unto the said Walter Berry and George St. H. Berry and
George Berry unto the said Samuel Ward and the Continental Bank Court on the said Mortgage to the
said Samuel Ward and the Continental Bank Court on the said Mortgage to the
