49 In Witness whereof I have hereunto set my hand, seal and bead this 23rd day of March 1841 Signed Sealed and delivered in presence of Ephraim Thayer Thomas Pike Samuel Perry State of Rhode Island in and County of Providence Charlestown March 23rd 1841 Before me Thomas Perry Notary came Mrs. Perry Interceder to the foregoing instrument and acknowledged the same to be her own act and voluntary act and deed Executed may 1st 1841 Before me Thomas Perry Notary By Per. Witnesses etc. To all people whom these presents come greets That I John R L Congdon of Charlestown in the county of Providence now state of Rhode Island known as Rhode Island Colony make it known that I do hereby grant for and consideraton of the sum of one hundred dollars to me in hand received the following described land and parcels partly by Mary E Herland of Charlestown in the county of Providence then Englandman the following Tract of land which begins at and among trees and stakes fences corners and bounds of and over and any part and parcel thereof in influence angles and directions hence by the said line 6 rods in her course Easterly and determination fence by these present have now granted given sold alien conveyed bargained sold conveyed and bargained the same part fully and absolutely quit grant Bargain sale clear enjoy convey bargain and unto the said Mary E Herland her heirs and assigns forever the certain parcel of land situated in the county of Providence and State Providence and amplitude as follows Viz namely on the east hand lying partly in Providence and partly in the town of Charlestown containing by estimation the following described plot acres with a dwelling house and other buildings thereon standing bounded on the north side by a lot parceled and now or state further on the east by lands of James Perry and the south by Thomas Perry bounded on the west side by Robert Walker on the North Road and Motbley on the south now or state of Edward and Stephen Perry The said tract having boundary by estimation on Southward trees and lying on the town of Charlestown road bounded Northside on the Pot Road eastward on lines now or state of Robert Reynolds and Peter Potter south east on lands now or state of Peter Potter and Nathan Herland on the northside and now or state of Thomas Perry Moreover the said home had bounded before on the northward the said tract containing three hundred acres and fifty perches by the said now or lot the said home was delivered in a certain deed given from the said grantor to daniel bartlett dated the 16th day of March 1822 to which referred my (He) intended to let the said grant and conveyed permanently with all the appurtenances namely privileges and commodities to the same belonging or in any way appertaining to the said Mary E Herland her heirs and assigns power to her and her male only purpose for her benefit and lawful peace and I the said John R L Congdon for myself and my heirs executors and administrators covenant promise and grant to me and the said Mary E Herland her heirs and assigns that at all times and forever this indentured land and lawfull and owner of the said land premises and am lawful seller and possessor of the same owner in my own proper right as a good proper and absolute estate of tenement or fee simple have and am lawfully right power for premises and lawful purpose to grant and convey full convey and bargain the said land permanent as aforesaid and the said Mary E Herland her heirs and assigns there and may from time to time and at all times manage and possess by peace and quiet of this present lawful purchase free and quietly have hold use enjoy possess and enjoy The said demise and bargain are performed only with the appurtenances free and clear and purely and plainly acknowledged created and discharged from and free from all manner of former or other grants bargains sell lease levy mortgage bills notes security surety assignment attorney and numbness of what name or nature howsoever that might in any meaning or sign stretch o make the personal seal and Hutternow I John R L Congdon for myself and my heirs foreverly and

S.C. and Commissioners, do covenant and engage the above demised premises to be his The said Mary G. Hortland and her heirs and assigns against all Lawful claims or demands of any person or persons whatever whatsoever to warrant demise and defend the tidy premises hereunto and the residue of the above assigning due is null That I the said Thos J. H. R. Congdon may have Conveyance or surrender hers’s as the hereby puts a bond to be paid to the said Mary G. Hortland and her heirs executors Assignees trustee and his heirs executors Commissioners, attorneys or successors for the sum of Two Thousand Dollars only to be paid upon the payment of any sum instant together with interest until the same be paid full Thus written above clear as a deed is also a Release bond even after with the said property given now to the said Mary G. Hortland for the payment of the sum aforesaid with interest at the time aforesaid shall be void Expired Had been removed for failure and void Witness my hand and seal of my office set my hand and seal office my date as the hereinbefore specified This fourth day of June in the year of our Lord eighteen hundred and forty one.
