KNOW ALL MEN BY THESE PRESENTS, that I, ELSONOR D. BAKER, of the Town of South
Kingstown, County of Washington, State of Rhode Island, for consideration paid, grant to
EDDIE SMITH and IVY SMITH, husband and wife, both of the Town of North Providence, County
of Providence, and State of Rhode Island, as joint tenants and not as tenants in common,
with WARRANTY CONVEYANTS
That certain tract or parcel of land situated in the Town of Charlestown, County
of Washington, State of Rhode Island, and bounded as follows:
Commencing at a drill hole in stone bound set at the point where
easterly line of lot 4 of the map of Mrs. Anna intersects the southerly line of
a street or way; laid out fifty (50) feet wide by the Grantor, it being the
northeasterly corner of lot 4, thence running thence southerly along
the northerly line of the street or way fifty one and one-hundredths (51.01) feet
to a drill hole in one stone boundary; thence at an angle of 80° 48' to the left
and running southerly 197.35 feet to a stone boundary, said distance easterly
line of Mrs. M. E. Annis land one hundred ninety-seven and eighty-nine and
one-hundredths (197.89) feet, thence running northerly to a stone boundary;
thence southerly in the same straight line seven (7) feet, more or less, on offset
to intersect the southerly line of the road which is shown on the map filed by the
United States Engineer Corps, as shown on plot hereto attached and made a part
hereof three hundred ninety-four and seventy-five hundredths (394.75) feet along the
pond until it intersects the easterly line of land of Mabel M. Anna; thence
turning and running northerly eleven (11) feet, more or less, and three to a drill
hole in a stone boundary; thence running northerly one line two hundred ninety
nine and eighty-three one-hundredths (299.83) feet to the place of beginning.
Bounded northerly by the street or way; easterly by fifty (50) feet of the land of
Grantor; easterly by land of the Grantor southerly by the nightwalker line of
Charlestown; and westerly by the land of the heirs of Mabel B. Anna, unless
otherwise bounded.
For a more particular description, see plot hereto attached and made a part hereof,
entitled, "Map of Land in the Town of Charlestown, R.I., on Pomquet Edge Plat
conveyed by Eleanor D. Baker to Eddie Smith and Ivy Smith, August 19, 1935, Luzon L.
Holland, Civil Engineer."
This lot includes by special permit the right of way to the ocean over the Grantors
reserved ocean frontage in Charlestown Beach, Washington County, R. I.
The above-described premises are subject to the following restrictions:
Said premises shall be used for residential purposes only and no buildings
except those necessary for the convenient use of the dwelling house thereon.
It is understood that private sewage disposal shall be installed thereof if needed at the
residence. To establish beneficial valuation on this property the residence
must be constructed at a cost of not less than ten thousand dollars; also, it is ex-
pressly understood that only one residence shall be erected thereon of a greater height than
four feet, in case of construction of any fence and Grantor reserves the right to revoke
thirty days' notice in writing and shall be and option to purchase the same
at the highest bona fide offer made to the Grantor, said the Grantors, their
heirs and assigns.
No poultry, sow, cattle, sheep, goats or pigeons nor any other objectionable
animals shall be kept or permitted to be kept upon the premises. No outside lav-
oratories shall be erected as a single building in itself. A water tight cesspool
shall be built and kept in sanitary condition at all times.
I, Howard Hamilton Baker, husband of the Grantor, release to said Grantees all my
right of curtesy and all other interest in the aforesaid premises.
