670 KNOW ALL MEN BY THESE PRESENTS: That we, AUGUST HOLTERHOFF and wife META HOLTERHOFF, both of the Town of Charlestown, County of Washington, State of Rhode Island (hereinafter called the mortgagors) in consideration of SEVEN THOUSAND ($7000.00) Dollars to us paid by the OLD COLONY CO OPERATIVE BANK, a corporation legally incorporated, and established and transacting business in the City of Providence in the State of Rhode Island, the receipt whereof is acknowledged, do hereby grant, bargain, sell and convey unto the said OLD COLONY CO OPERATIVE BANK (hereinafter called the mortgagee), its successors and assigns, forever, PARCEL 1. That certain lot or parcel of land with all the buildings and improvements thereon, situate at the southeasterly corner of Old Post Road and the Highway leading East in said Town of Charlestown, County of Washington, State of Rhode Island, laid out and designated as Lot No. 4 on that platted entitled Indian Lane, Book 266, Page 588, recorded 8th day of September 1925, which plat is recorded in the office of the Clerk of the Land Evidence of said Town of Charlestown in Book 266 at page 588. Said lot is bounded and described as follows: Beginning at said corner and running westerly bounding northerly on said Post Road one hundred eighty- five (185) feet; thence turning east and running northerly one hundred forty- seven (147) feet; hereinafter described as boundary (2) feet turning and running easterly bounding northerly on Parcel 3 hereinafter described, one hundred ninety-one (191) feet; thence turning east and running to Post Road one hundred thirty (130) feet turning and running northerly bounding easterly on said highway Two hundred thirty (230) feet to the first mentioned and starting point. PARCEL 2. Also a strip of land fifteen (15) feet wide by two hundred thirty (230) feet in length adjoining the westerly line of said Parcel 1. PARCEL 3. Also a strip of land ten (10) feet wide by two hundred (200) feet in length adjoining Parcel 1 and Parcel 2 on the south. Excepting all rights and title to and an Old Indian Burying Ground as shown on said plat. Together with all buildings and improvements now or hereafter erected thereon, all the hereditaments, appurtenances and rights thereunto belonging or in any wise now or here- after appertaining, the rents, issues and profits thereof, and all plumbing, heating, light- ing and other fixtures, equipment and articles now or hereafter attached thereto. TO HAVE AND TO HOLD the aforementioned premises, with their appurtenances, unto and to the use of the said mortgagees, its successors and assigns, forever. As to Parcel 1 the said mortgagors do hereby, for themselves and for their heirs, executors and administrators, covenant with the said mortgagees and its successors and assigns, that they are lawfully seized in fee simple of the said granted premises; that the same are free from all incumbrances; excepting rights and title to said burial ground; that they have good right, full power and lawful authority to sell and convey the same in manner as afore- said that the said mortgagees, and its successors and assigns, shall by these presents at all times hereafter peaceably and quietly have and enjoy the said premises and that the said mortgagors will, and their heirs, executors and administrators shall, warrant and defend the same to the said mortgagees, and its successors and assigns, forever, against the lawful claims and demands of all persons excepting as to said rights and title to said burial ground. The above covenants do not apply to Parcels 2 and 3 above described. And for the consideration aforesaid, we August Holterhoff and Meta Holterhoff do hereby release all our right of curtesy and dower and all other rights, statutory or otherwise, in and to the said granted premises unto the said mortgagees, and its successors and assigns, forever. PROVIDED, NEVERTHELESS, this conveyance is made upon the express condition that, if said mortgagors, or their heirs, executors, administrators or assigns, shall pay unto the said mortgagees, or its successors or assigns, the sum of SEVEN THOUSAND ($7000.00) Dollars, together with the interest therein, in monthly installments of ONE HUNDRED FORTY ($140.00) Dollars each payable on the 26th day of each and every month succeeding the date

672 AND FURTHERMORE, the said mortgagors, for themselves and for their heirs, executors, administrators and assigns, for the consideration aforesaid, and to further increase the security of this mortgage, do hereby covenant and agree to and with the said mortgagee, and its successors and assigns, as follows: 1. To pay all indebtedness hereby secured in accordance with the tenor of said note, all taxes and assessments of every nature levied upon or to be levied upon said premises or upon the mortgagee, its successors and assigns, in respect to this mortgage or the indebtedness, whether under statutes now in force or that may hereafter be enacted, all premiums for insurance maintaining said premises upon said premises, and rates and taxes for water and sewer hereby secured as a home residence. 2. To keep and maintain insurance against loss by fire upon the buildings and appurtenances on said premises and in case of loss or damage to said mortgage, its successors and assigns, in at least such amount as not less than SEVEN THOUSAND $7000.00 but not more than TEN THOUSAND $10,000.00, in any company or companies of solumnsure clauses, and in such form and in such company or companies as shall be satisfactory to the mortgagee, its successors and assigns, and the mortgagee hereby authorized to effect such insurance through such brokers or agents as they may deem proper, and to pay the premiums thereon, and to make the policies payable to the heirs, executors, administrators and assigns, whether or not required be the mortgagee, its successors and assigns, and in the event of any loss or damage thereto be delivered, to said mortgagee, its successors and assigns hereby making a full, free, and irrevocable assignment of the loss payable money provided the mortgagee or its successors and assigns be the vice President for the time being of said OLD COLONY CO OPERATIVE BANK, or its successors and assigns, the uncontrolled discretion of its attorneys, irrevocably in their amount, not less than SEVEN THOUSAND $7000.00 dollars, and to make and keep such insurance in force, to prevent the loss of collateral insurance claims, and in such form and in such company or companies as shall be satisfactory to the mortgagee, and to empower the mortgagee and its heirs, executors, administrators and assigns, to be fully authorized to step in and hereby authorized to effect such insurance through such brokers or agents as they may select, and to pay the premiums therefor, and to charge the same to the heirs, executors, administrators and assigns, whether or not they required the insurance to be so effected, and the premiums so paid shall be a sum of money thereof to be delivered, to said mortgagee, its successors and assigns hereby making a request for the
