SHEA, JR. and MARY A. SHEA, husband and wife, both of the city of Pawtucket, County of Providence and State of Rhode Island, hereinafter referred to as the Grantees. WHEREAS, CHARLESTOWN ESTATES is the owner of a tract of land ten (10) feet in width, bounded easterly by land now or formerly of Lila Craig Coupe and westerly by land now or formerly of Sophia E. Doume in as described in that certain deed from Charlestown Estates, Inc. to Charles E. Doume, Jr. dated July 17, 1959 and recorded in the Land Evidence Records in the Land Evidence Book #28 at Page #32, said land being in the Town of Charlestown, Rhode Island in Book #28 at Page #32, said land being in the Town of Charlestown, Rhode Island. WHEREAS, the grantees are the owners of certain real estate located in said Charlestown designated as lot #25 on plat evidence, "equinoctian Highlands, property of Charlestown Estates, Inc., Charlestown, R. I." said lot #25 being a corner lot bounded on the north by Main street as filed with the Land Evidence Records of said Town of Charlestown. WHEREAS, CHARLESTOWN ESTATES having developed the land shown on the above mentioned plat and subsequently conveyed the grantees, the above mentioned ten (10) foot strip of land, together with certain appurtenant rights thereto was created and remains under said ten (10) foot strip of land in common with others, and WHEREAS, it is the desire of the parties hereto that the grantees release all rights in relation to said ten (10) foot strip and in exchange therefore accept a right to cross and recross other property of Charlestown Estates leading to the above mentioned lot #25. NOW THEREFORE, in consideration of the discharge and release of said right and the conveyance of the new right of way, it is agreed as follows. 1. The grantees hereby grant and release to and discharge Charlestown Estates with QUIT CLAIM COVENANTS, all right, title and interest in and to said ten (10) foot strip and the rights thereto, all 2. Charlestown Estates grants to the said grantees, their heirs, executors, administrators, assignees, licensees, grantees and servants with QUIT CLAIM COVENANTS a right to cross and recross to and from the beach or ocean, in common with others, lot #25 and a 20 foot wide area at the beach as shown on that certain plan or plat reference "Equinoctian Highlands Beach at Jennucourt, R.I., property of S. N. Davis, Inc., Leon L. Holland, C. E., scale 1 inch equals 100 feet, revised July 1951." which plat is duly filed in the Land Evidence Records of Charlestown.
