MORTGAGE DEED 463 and Susie M. Gabrielle, KNOW ALL MEN BY THESE PRESENTS, That We, Americo J. Gabrielle, husband and wife, both of the Town of Charlestown, County of Washington and State of Rhode Island hereinafter called the "mortgagor(s)" in consideration of Six Thousand (6,000.00) DOLLARS to be paid by PLANTATIONS BANK OF RHODE ISLAND, a banking corporation legally incorporated and established under the laws of the State of Rhode Island, and having its principal place of business in the City and County of Providence in said State, (hereinafter called the "mortgagee"), the receipt whereof is hereby acknowledged, do hereby grant unto the said mortgagee, its successors and assigns, forever, with MORTGAGE COVENANTS, to secure the payment of the principal and interest of and a certain promissory note of the mortgagor(s) of even date herewith, the following described real estate: a certain parcel of land with all buildings and improvements thereon situated, Located at Quonochonticut Beach, in said Town of Charlestown, Rhode Island, on the east side of East Beach Road, measuring approximately one hundred forty-four and one hundred Sixty-six (144 66) on a plan entitled "Revised Plat of Cottage Sites, in Property of N. B. Burdick, Quonochonticut East Beach, Charlestown, R. I.," said plan being on record in the Town of Charlestown, said plan was filed in August, 1921, and recorded in the office of the Town Clerk of said Town of Charlestown in Plat Book 2, Pages 43-44, said estate of beginning. Beginning at the northeasterly corner of said lot at a point in the easterly line of East Beach Road called, which is also the southeasterly corner of Lot No. 65 as shown on said plan, thence easterly eighty feet, boundary line of Lot No. 65; thence southerly One hundred twenty-six (126.25) feet to the northeasterly corner of Lot No. 52; thence easterly one hundred five (105) feet, boundary line of Lot No. 52, Seventy-four and 30/100ths (74.30) feet, thence south to the west line of Lot No. 51, thence running westerly eighty-four and 40/100ths (84.40) feet to the corner of a cutting-off curve having a radius of 100 feet, more or less, to the beginning of a curve running southeasterly, said curve running south easterly to a point in the easterly line of East Beach Road, and thence running northerly along the easterly line of East Beach Road to the point of beginning, more or less a distance of 200 feet. This conveyance includes a Right-of-way forever, in common with others, to Charlestown Point over Cross Street and Provenet Avenue, and a 20 foot Right-of-way easterly from Provenet Avenue to a point directly easterly of Lot No. 32 as shown on said plan. As a part of the consideration for this deed, the within grantors, for themselves and their heirs, administrators, executors and assigns forever, covenant and agree to maintain in good repair the east side of East Beach Road from the northeasterly corner of said Cross Street extending from the east line of said East Beach Road to the west line of Provenet Avenue Road. Being the same premises conveyed to the mortgagors by own L. Bendelow et al by said reference recorded in Charlestown Land Evidence Book 35, page 380. This mortgage is made upon the STATUTORY CONDITION and with the STATUTORY POWER OF SALE implied, however, that notice of the time and place of a foreclosure sale may at the option of the mortgagee be published either as provided in and by said STATUTORY POWER OF SALE or in some newspaper published in the City of Providence, State of Rhode Island and that a foreclosure sale may at the option of the mortgagee be held either upon the premises or elsewhere as specified in said notice. This mortgage is made subject to those additional covenants and agreements contained in an instrument entitled "ADDITIONAL COVENANTS OF MORTGAGORS OF PLANTATIONS BANK OF RHODE ISLAND," a copy thereof having this day been received for the mortgagor(s), the receipt whereof is hereby acknowledged, and the exact terms of which are recorded in the Records of Land Evidence in said Town of Charlestown in Mortgage Book 35, at page 380. Said additional covenants and agreements are hereby made a part of this mortgage by reference and if default shall be made in the performance or observance of any of said covenants and agreements, it shall be lawful for the mortgagees to sell the above described premises pursuant to said statutory POWER OF SALE as supplemented by this instrument. And for the consideration aforesaid, we, Americo J. Gabrielle and Susie M. Gabrielle, do hereby release our rights of power () and (courtesy) in and to the said granted premises unto the said mortgagees, its successors and assigns, forever.
