369 STATUTORY FORM EXECUTORS DEED KNOW ALL MEN by THESE PRESENTS, that I, M. Louis Abedon, of the City of Providence in the State of Rhode Island, in my capacity as Executor of the Last Will and Testament of Hilyer G. Senning, late of the Town of Charlestown, in said State of Rhode Island by virtue, and in exercise of the power and authority and me invested by the Last Will and Testament of said Hilyer G. Senning, late of said Town of Charlestown deceased, and of every other deed power me heretofore enumerated, in consideration of the sum of Eighteen Thousand ($18,000.00) Dollars to me paid by Beatrice H. Twiname, of the City of Bridgeport Manor, County of Westchester, State of New York the receipt whereof is hereby acknowledged, to hereby give, grant and convey unto her the said Beatrice H. Twiname, her heirs and assigns forever, in FEE SIMPLE, A certain tract or parcel of land with buildings and improvements thereon situated and lying in the Town of Charlestown, County of Washington and State of Rhode Island launched and bounded and described as follows, to wit:— Lot #104 as shown and delineated on a certain plat or plan entitled "Plat of Quonochonticut Beach, Charlestown, R.I., 1936" said plat or plan being recorded in the Land Evidence book 28, page 136 of the Town of Charlestown, said plat or plan being dated September 10th, 1936. Said plan or plat being on file in the Town Clerk's Office in said Town of Charlestown. Said Lot #104 is bounded on the North by Lot #103, on the South by Lot #105, and on the East and West by the ocean. Said lot or tract on foot or on footpaths over, over, and across and through the rights of way and roads as shown on said plan is reserved for the right of way leading from the road to the ocean and THORP and NELSON M. THORP, both of the Town of Westerly, County of Washington and State of Rhode Island, for consideration paid grant to ROBERT B. BARBONS and DORIS S. BARBONS, husband and wife, both of West Hartford, County of Hartford and State of Connecticut, as Joint Tenants and not Tenants in common, Meaning to the survivor, with WARRANTY CONVEYANCE, A certain tract or parcel of land situated and located at Quonocutong Central Beach, so called, in the Town of Charlestown, County of Washington and State of Rhode Island bounded and described as follows, to wit: Beginning at a point on the southerly line of Sea Breeze Avenue, said point being the northeasterly corner of the parcel herein conveyed and the northeasterly corner of land of George A. Prior, Jr. and Eleanor B. Prior thence easterly along said southerly line of Sea Breeze Avenue to the northeasterly corner of twenty (20) feet the northeasterly corner of the parcel herein conveyed thence turning a right angle and extending southerly along the easterly line of the parcel herein conveyed twenty (20) feet to the northeasterly corner of twenty (20) feet thence turning a right angle and extending easterly one hundred twenty (120) feet to a point on the southerly line of Prior land thence turning a right angle and extending southerly sixty (60) feet to a point on the southerly line of Prior land thence turning a right angle and extending westerly one hundred twenty (120) feet to a point on the easterly line of the parcel herein conveyed thence turning a right angle and extending northerly one hundred thirty-two (132) feet to the point of beginning the above described parcel being a portion of the parcel conveyed to the grantor herein by a deed from Prior land and land of Arthur C. Said grantees, their heirs and assigns, shall have the right to pass and repass from and to and from said to lot or tract on foot or otherwise, over and on, across those certain rights of way or roads as shown on the above mentioned plan. The grantors further reserve unto themselves, their heirs and assigns, Central Beach, dated October 1st, 1924, revised September 10, 1962, turning to the beach and along the site as shown on the above mentioned plan. The grantors further reserve unto themselves, their heirs and assigns, the right hereinafter be designated for public use: the said grantees, for themselves, their heirs and assigns, agree covenant and agree to maintain the said rights of way and roads and the said grantees, their heirs and assigns, will agree and shall agree to pay Quonocutong Central Beach Fire District, three (3) dollars for each lot (or lots) herein conveyed, said sum to be expended and applied by the said Quonocutong Central Beach Fire District, its successors and assigns, in the best manner they see fit, and the said sums shall be paid in the first instance to the said Fire District, and may be designated for public use, and the said sums agreed to be said her yearly a lien and charge upon the premises herein conveyed, and in case of any failure in the payment of said sums the said Fire District, its successors and assigns, shall be lawfully entitled for the said unpaid sums to the said Fire District, its successors and assigns, to sell the premises or any part thereof at public sale, this conveyance is made and accepted subject to the following conditions and restrictions, NAMELY: 1. In case of a contemplated sale of mid lot or lots of any of the above, Homard E. Thorp and or Nelson M. Thorp, their heirs and assigns, shall be given ten days notice in writing and shall have the first option to purchase the same at the buildings and improvements thereon, at the highest bona fide price in good faith made and actually offered to the said grantees, their heirs and assigns.
