359 CURATIVE AND CORRECTIVE WARRANTY DEED (Statutory Form) Whereas by a warranty deed dated the 5th day of June, A. D. 1961, Benjamin C. Gavitt, of the Town of Charlestown, County of Washington, State of Rhode Island, conveyed to Glenn F. Godden and Mildred L. Godden, both of said Town, County and State, as joint tenants and not tenants in common, with WARRANTY CONVEYANTS certain real estate described therein and hereinafter described in this deed: And whereas in said deed maid grantor, Benjamin C. Gavitt, effected those conveyances as made by Benjamin C. Gavitt and those conveyances made by the late Bessie C. Gavitt, whereas as a matter of fact said grantor made and intended to effect those conveyances as made by Benjamin C. Gavitt which were recorded or of record and also meant and intended to effect those conveyances made by the late Bessie C. Gavitt which were recorded or of record: And whereas further said grantor in said deed stated that he conveyed "all his right, title and interest in and to the real estate herein described and hereinafter described, and whereas as a matter of fact said Benjamin C. Gavitt meant and intended in said deed to convey absolute title with warranty covenants to said real estate described in said deed and as hereinafter described excepting only the portion of land definitely excepted in said deed and reserved to said grantor and hereinafter excepting only conveyances of record as aforesaid; NOW THEREFORE, I, Benjamin C. Gavitt, of the Town of Charlestown, County of Washington, State of Rhode Island, in consideration of $1.00 and other good and valuable consideration, the receipt whereof is hereby acknowledged, grant to Glenn F. Godden and Mildred L. Godden, husband and wife, both of the Town of Charlestown, County of Washington, State of Rhode Island, as joint tenants and not tenants in common with WARRANTY COVENANTS, That certain parcel or tract of land located on the westerly side of South County Trail, so-called, in the Town of Charlestown, County of Washington, State of Rhode Island, as more fully described in said grant or tract of land being bounded and described as follows, vit- Easterly by land now or formerly of Melissa H. [?] and the State Highway; southerly and westerly partly by land now or formerly of Colin S. [?] and others, and partly by land now or formerly of James R. Kennedy north-easterly by lands now or formerly of Ambrose Huts, [?] Carpenter heirs, James Hazart heirs, and Fast Cousens, otherwise over either property lines may be bounded and described as follows: EXCEPTING the parcel of land which the grantor herein, namely Benjamin C. Gavitt, reserves to himself as is described below and further that Colin S. [?] and others, and those conveyances as made by Benjamin C.
