354 We, David P. Reid and Sue B. Reid, husband and wife, both of the City of Cranston, County of Providence, State of Rhode Island for consideration paid, grant to Clifford L. Nelson and Kenneth A. Nelson, father and son, both of East Berlin, State of Connecticut, as JOINT TENANTS, and not as tenants in common with WARRANTY COVENANTS (Description, and Incumbrances, if any) That certain parcel of tract of land, together with all the buildings and improvements thereon situated located in the Town of Charlestown, County of Washington, State of Rhode Island, bounded and described as follows, viz: Beginning at a point marking the northeasterly corner of land now or formerly of Eliza- beth Banham and the southeasterly corner of the within premises, thence the line runs south westerly, bounded westerly southerly by land now or formerly of [?] by a distance of 251 feet, more or less, to a stone bound set in the ground, and continuing thence in the same straight line, bounded southerly by land now or formerly of [?] by a distance of 50 feet, more or less, to the shore of Charlestown Pond; thence following the shore of said pond a distance of 118 feet, more or less, until it comes to the southeasterly corner of land now or formerly of Leon R. Crispin and [?] and continuing thence easterly or northeasterly on the boundary bounded westerly or northeasterly by said Crispin land and the shore a distance of 210 feet, more or less, or until it comes to the southeasterly corner of Crispin land and the shore, thence in a straight line, bounded southerly by land now or formerly of Gene and one or formerly of George N. Webster and Lucy A. Webster, a distance of 118 feet, more or less, to the point and place of beginning, on bounded northerly by the shore of said pond bounded easterly, describing the right as an appurtenant hereto and means and perps over certain delineated right of way of ingress and egress as a right of way over and across said right of way and the right of way leading from the premises herein conveyed to the public Highway known as Post Road. The premises herein conveyed are the same premises as were conveyed by Earl Y. Fisher to David P. Reid and Sue B. Reid, by deed recorded in the Town of Charlestown, "L.E." Book No. 30, at Page 461. Reference is also made to the conveyance of Robert H. Mills, Jr. et al to William H. Banham et al., see Land Evidence Records of the town of Charlestown, "L.E." Deed Book No. 33, at Page 111. The grantors hereby reserve to their the right of way now in existence and said conveyance is made and made a reference by part hereof. We, David P. Reid and Sue B. Reid, husband and wife the grantors release to said grantee all our rights of curtesy and dower and all other interest in the aforementioned premises. WITNESS our hands this 1st day of June 1962. 355 The real estate, together with all buildings and improvements now or hereafter erected thereon, and all plumbing, heating, lighting and other fixtures, equipment and articles now or hereafter attached thereto, situated in the Town of Charlestown Rhode Island, northboundly described as follows: Beginning at a point marking the northeasterly corner of a parcel of land now or formerly of Elizabeth Bancroft and the southeasterly corner of the said north line, thence running the line runs, southerly, bounded southerly by said Bancroft land, a distance of 373 feet, more or less, to a stone bound set in the ground, and continuing thence in the same straight line, bounds still southerly by said Bancroft land, a distance of 165 feet, more or less to a line running southeasterly, following the line of the road, a distance of 118 feet, more or less, or until it comes to the northeasterly corner of land now or formerly of John G. Gorton, thence running the line runs, southwesterly, bounded southeasterly by said Gorton land, bounded westerly or northeasterly by said Gorton land a distance of 210 feet, more or less, or until it comes to the northeasterly corner of land now or formerly of John G. Gorton as described in the deed herein conveyed; thence the line runs southeasterly in a straight line, bounded northeasterly or easterly by land now or formerly of John G. Gorton, a distance of 118 feet, more or less, or until it comes to the point and place of beginning, or however otherwise said premises may be bounded and described. Together with the right of way for ingress and egress over land now or formerly of Elizabeth Bancroft and/or rights of way as are contained in the title deeds of record, said right and/or rights of way leading from the premises herein conveyed to the public highway known as Post Road. I, Kenneth A. Nelson, covenant that I am single and unmarried. This mortgage is made under the STATUTE CONDITION subject and with the STATUTORY POWER OF SALE, provided, however, that publication of notice of a foreclosure sale may be made alternatively in a public newspaper published in the City of Providence, and that a foreclosure sale may be held upon the premises or elsewhere at the option of the mortgagee, as specified in said notice. This mortgage is made subject to those additional covenants and agreements contained in STATEMENT OF COVENANTS AND AGREEMENTS, executed this day by the mortgagors, the exact terms of which are on record in main "Book of Charlestown, R. I. in Mortgage Book 37, at page 30. Said covenants and agreements are made part of this mortgage, and if default shall be made in the performance or observance thereof it shall be lawful for the mortgagee to sell the above described premises pursuant to said STATUTORY POWER OF SALE.
