270 KNOW ALL MEN BY THESE PRESENTS: That we, MILDRED M. GRIFFIN and MABEL D. MATTHEWS, of Pawcatuck, Connecticut, hereinafter called the "mortgagors," in consideration of Twenty-one Hundred & 00/100 ($21,100.00) Dollars, said by INDUSTRIAL NATIONAL BANK OF RHODE ISLAND, a national banking association organized and existing under the laws of the United States of America, with its principal place of business in the City and County of Providence, in the State of Rhode Island, hereinafter called the "mortgagee," the receipt whereof is hereby acknowledged, do hereby grant to the mortgagee, its successors and assigns forever, WITH MORTGAGE COVENANTS, to secure the payment of the principal and interest of a certain promissory note of the mortgagor of even date herewith and bearing the serial number herewith, the following: Three parcels of land together with, the buildings and other improvements thereon, situated in the Town of Charlestown, County of Kent, in the State of Rhode Island, being shown and delineated as lots number eight (8) and nine (9) on plat called, "Section No. 1 Shady Harbor in Charlestown, R. I., Enlarged to show tracts acquired since 1923," dated May 1959, Survey by, Harry J. Moore, May 1959, and recorded May 17, 1960, which said plat is recorded in Plat Book No. 2, in the Land Evidence Records of said Town of Charlestown. Being the same land and premises now the mortgagors, as joint tenants, by deeds of Everett E. Graham and Sydney Cody dated August 13, 1929 and September 15, 1950, recorded in Book 31, page 631 and Book 32, page 267, respectively, of the Land Evidence Records of said Town of Charlestown, and subject to those covenants and restrictions contained therein. This mortgage is made under the STATUTORY CONVEYING statute and with the STATUTORY POWER OF SALE provided, that publication of notices of a foreclosure sale may be made alternatively in a public newspaper published in the City of Providence, and that the mortgagee may foreclose the premises as a foreclosure of a mortgage of the mortgagors, as specified in said statute. This mortgage is made subject to those additional covenants and agreements contained in a STATEMENT OF COVENANTS AND RESTRICTIONS, a copy of which being this day delivered to the mortgagor, the receipt whereof is hereby acknowledged, the exact terms of which are on record said Charlestown in Book 34, at page 40, said covenants and agreements being hereby incorporated herein by this reference, and if omitted shall be deemed to be in the presence or absence of any of the same, it shall be sufficient for the mortgagee to sell the above described premises pursuant to said STATUTORY POWER OF SALE.
