235 PARTIAL RELEASE of MORTGAGE KNOW ALL MEN, that the WASHINGTON TRUST COMPANY, a Rhode Island corporation, located and having its principal office and place of business in the Town of Westerly, County of Washington, State of Rhode Island, the holder of a mortgage by Robert M. Mills, Jr. and Ida M. Mills, husband and wife, both of the Town of "Charlestown," County of Washington and State of Rhode Island, said the Washington Trust Company, dated May 13, 1960 and recorded in Book No. 37 at page 229 and 37, for consideration paid, release to said Robert M. Mills, Jr. and Ida M. Mills all interest acquired under said mortgage in the following described portion the mortgaged premises: That certain lot or parcel of land situated in the Town of Charlestown, County of Washington in the State of Rhode Island, it being the same premises conveyed to said parties by Arthur Young Surveyor, recorded in Book No. 38, page 1 Scale 1 inch = 100 feet Nov. 9, 1959, A. B. Emerson, Civil Engineer, recorded in Book No. 37, page 3 a way and easements as now existing on run in connection with the properties, their tenures heirs and assigns, to and pass on resorts and foot with in the way and easements that lead toward said parcel herein described and that right of way and easements shall be co-extensive with whatever rights of way and easements the grantors now have and enjoy from said foot path to said parcel herein conveyed and subject to such rights of way and easements as may be hereafter recorded hereon conveys and rights and easements of way and easements shall be appurtenant to the parcel herein conveyed. Subject to restrictions of record, and subject to any existing easements granting rights of way for power and lines. The above described premises being a portion of the premises conveyed to the said Robert M. Mills, Jr. and Ida M. Mills, by Philip H. Howard, Trustee, dated June 1, 1959, recorded in the Land Evidence Records of the Town of "Charlestown," R. I. in Book 36 at page 311, which tract is a portion of the "Fourth" tract in said mortgage dated May 13, 1960, between said parties, dated May 13, 1960 and recorded in Charlestown Land Evidence Records in Book No. 37 at page 229 and 37. But this release shall not in any way affect or impair the right of the Washington Trust Company to hold under the said mortgage and as security for the sum remaining due therein, or to sell, under the power of sale in said mortgage contained, all the remainder of the premises therein conveyed and not hereby released.
