Know All Men by these presents, that I, Justice Pease, of the town of Madison, in the county of Washington and state of Rhode Island, residing therein, law of case of death, Pease, late of said Madison deceased intestate, administrator called the mortgagor, in consideration of thirty four hundred and fifty (3450) dollars loan to me paid by Harriet G. Newcomb, of said Madison, hereinafter called the mortgagee, the receipt whereof is hereby acknowledged, do hereby grant, bargain sell, alien and convey into the said mortgage, and her successors and assigns forever, a certain lot of land lying and being in the town of Glocester, in said county, with all its privileges and appurtenances thereon lying and being on N.W. part of a lot conveyed out of said town from Elizabeth shell to Thomas Barker by a deed dated September 28th 1858 and recorded in East Glocester deeds record of said towns, in Book 10 page 558 and said year being recorded in said Glocester town records in Book 10 page 557 to which lot last and to the peer further reference is hereby made and used for a more particular description of these premises, and the same being made a part hereof, To have and to hold, the aforesaid premises, with all the premises and appurtenances hereunto belonging unto and to the use of the said mortgagee, and her heirs and assigns forever, And I to said mortgagee, to hereby, covenant for myself and for my heirs executors and administrators covenanted with the said mortgagee and her heirs and assigns that I am completely seized in the simple of the said granted premises, that the same are free from all manner burdens except our outstanding life estate its arbitrary in thomas Barker, that I have good right, full power and lawful authority to sell and convey the same in manner as aforesaid; that the said mortgagee and her heirs and assigns shall by these presents or at all times hereafter peaceably and quietly have and enjoy the said premises, and that I, the said mortgagor will, and my heirs, executors and administrators shall, warrant and defend the same to the said mortgage and her heirs and assigns forever against the lawful claims and demands of all persons except the cutting until the death of Thomas Barker. And for the annunciation foregoing I, Mary E. Barker wife of said Justice Pease do hereby release all my right of tenure in and to the said granted premises unto the said mortgagee and her heirs and assigns forever. Provided however, that this conveyance and is made upon the express condition, That if the said mortgagor or her heirs executors, administrators or assigns, shall pay into the said mortgagee or her executors, administrators or assigns, the sum of 3450 dollars whereby the said

440 mortgage or has made the negotiable promissory note for said sum for said term, bearing from date with these presents, had and made payable to the order of Harold S. Keough six months from the date hereof, with interest thereon at the rate of 6 per centum per annum, payable semi-annually while said principal sum is paid, whether by one or either maturity, and as otherwise marked in witness whereof both or either meaning, to bear interest at the rate aforesaid until paid, and executed as a pay off and release and assignment of every kind and void and voided upon or in respect of and premises, then this deed, at its acts and promissory note, shall become and be absolutely void and to all intent and purposes ineffective. But if default shall be made in the payment of the said note, or of said interest at the time limited and in the manner aforesaid, or of the taxes or assessment assessed at the same icome property, or remaining unpaid upon said granted premises rendering and paying the surplus of said proceeds of sale if any be there over and above the amount to be retained as aforesaid together with costs and for their own account of such sale or sales of parcels or conveyancy to the said fletcher barber and henry E. Barber their heirs specialtes administrators or assigns in whom or ones or more may be assigned such transfer be a perpetual sale in fee and conveyancy absolute the said fletcher Barber and henry E.
