daughters, Edith L. Parker, of Westerly, Rhode Island, and Evelyn L. Reynolds, of said South Kingstown, or wholly to the survivor of them, PROVIDING, HOWEVER, that the child or children equally of either of my said daughters who shall predecease me shall have and receive that share of my estate which my daughter, so de- ceased, would have had if living at my death. NINTH: Having the full confidence in the character and understanding of both my said daughters, I make no reservation herein for my son, Frank L. Fitzgerald, Jr. TENTH: I expressly authorize and empower my executor named, to sell, mortgage, pledge, lease for years or per year or will, or otherwise alienate and convey my estate or any part thereof, upon the terms and for such periods as my said executor may, in his unrestricted discretion, determine, without in any instance obtaining the prior advice, consent, approval or decree of any court of the judicature; and everyone dealing with my said executor shall be under no duty to see the proper application of the proceeds of, or the consid- eration for, any such transaction. ELEVENTH: I hereby nominate and appoint my said husband, Frank L. Fitzgerald, sole executor of this my last will and testament, and request that he be not required to furnish surety upon his official bond as such executor. DUHAMEL, as joint tenants with the right of survivorship and not as tenants in common, with WARRANTY COVENANTS-- That certain tract or parcel of land, together with the buildings and other improvements thereon, located in the Town of Charlestown, County of Kent, State of Rhode Island, bounded and described as follows: BEGINNING at the northeasterly corner of the stone boundary herein described at the end of a stone wall on the southeasterly side of the road now or formerly known as the Post Road; said wall being 317 feet more or less, easterly of the center line of a gravelled road that leads southeasterly from said Post Road to the aforementioned stone boundary; said stone wall a distance of 235 feet to a point; thence turning and running easterly a distance of 150 feet to a point; thence running southeasterly 175 feet perpendicular from said stone wall; thence running southeasterly in a straight line a distance of 235 feet to a point on the southeasterly side of said Post Road; said last mentioned point being 130 feet easterly of the point of beginning; thence running northwesterly by said Post Road, a distance of 150 feet to the point and place of beginning. Being the same premises conveyed to the grantor by deed of Edward C. That certain parcel or tract of land with all the buildings and improvements thereon, situated in the Town of Charlestown, County of Washington and State of Rhode Island, known and described as follows: Beginning at a point on the westerly side of the State Highway commonly known as "Moss Hill Road," at the easterly end of a stone wall running northerly the perimeter of the premises herein conveyed, at a point; thence running southerly along said State Highway a distance of the 140 feet to a point; thence running westerly, maintaining a distance of one Hundred (100) feet distant from and parallel to said stone wall, a distance of 140 feet to a point; thence running northerly a distance of 100 feet parallel to said stone wall, a distance of 140 feet to a point; thence running northerly, maintaining a distance of one Hundred (100) feet to said stone wall; thence running easterly bounded northerly by said stone wall, a distance of one Hundred (100) feet to the point and place of beginning.
