Mills, Jr. and Ida M. Mills, husband and wife, both of the Town of Charlestown, County of Washington and State of Rhode Island, said the Washington Trust Company, dated May 13, 1960 and recorded in the Land Evidence records of said Town of Charlestown, Rhode Island in Book No. 37 at pages 236 et seq., for consideration paid, release to said Robert M. Mills, Jr. and Ida M. Mills all interest acquired under said mortgage in the following described portion of the mortgaged premises: That certain lot or parcel of land situated in the Town of Charlestown, County of Washington, in the State of Rhode Island, being Lot Number "31" on that plat entitled "WOOD SHORE ACRES in the Town of Charlestown, R.I. ALIN, husband and wife, of Charlestown, Rhode Island, hereinafter called the "mortgagors," in consideration of Sixteen Thousand & 00/100 ($16,000.00) Dollars, to us paid by INDUSTRIAL NATIONAL BANK of Providence, a national banking association organized and existing under the laws of the United States of America, with its principal place of business in the City and County of Providence, in the State of Rhode Island, hereinafter called the "mortgagee," the receipt whereof is hereby acknowledged, do hereby grant to the mortgagee, its successors and assigns forever, with MORTGAGE COVENANTS, to secure the payment of the principal and interest of a certain promissory note of the mortgagor of even date herewith and bearing the serial number before her, the following: That certain parcel or part of land, together with the buildings and other improvements thereon, situated therein, located in the town of Charlestown, County of Kent, State of Rhode Island, bounded and described as follows: BEGINNING at a point on the northerly side of the Highway, commonly known as the Point Road, at the southerly corner of said Highway, bounded westerly by said Charlestown a distance of 200 feet to a point; thence running northerly, bounded easterly by said Highway land now or formerly of Edward M. Mills to a point; thence running northerly, bounded easterly by said Highway land now or formerly of Edward M. Mills to a point, a distance of 325 feet; thence running easterly, bounded northerly by the boundary of the premises herein set, a distance of 400 feet; thence running northerly, bounded easterly by land now or formerly of said State Highway; thence running southerly, bounded easterly by land now or formerly of said State Highway; thence running south westerly, bounded southerly by said State Highway, a distance of 325 feet to the point and place of beginning. Being the same premises conveyed to the mortgagors by deed of Edward C. Dubman and Harriet M. Dubman, dated November 18th, 1955 and recorded in Book 35, at page 520 of the Charlestown Land Evidence Records. This mortgage is made upon the STATUTORY CONDITION and with the STATUTORY POWER OF SALE; provided, however, that publication notice of a foreclosure sale may be made by the mortgagee in a newspaper published publicly in the City of Providence, and that a sufficient number of such publications shall be deemed to have been made as required by the mortgagee, as specified in said notice. This mortgage is made subject to all terms, conditions, covenants and agreements contained in a STATEMENT OF COVENANTS AND AGREEMENTS, a copy of which, having been this day received by the mortgagor, the receipt whereof is hereby acknowledged, the exact terms of which are on record in said Charlestown in Book 34, at page 40, said covenants and agreements are hereby by reference made a part of this mortgage, and if any default shall occur in the covenants or agreements on the part of the mortgagor, it shall be lawful for the mortgagee to sell the above described premises pursuant to said STATUTORY POWER OF SALE.
