367 KNOW ALL MEN BY THESE PRESENTS: That we, Vincent G. Mullen and Mary G. Mullen of the Town of Charlestown, Washington County, Rhode Island (hereinafter called the mortgagors) in consideration of Eight Thousand Four Hundred & no100 ($8,400.00) Dollars to us paid by the RIDE ISLAND HOSPITAL TRUST COMPANY, a Corporation legally incorporated, and establishing and transacting business in the City of Providence in the State of Rhode Island, the receipt whereof is acknowledged, do hereby grant, bargain, sell and convey unto the said RIDE ISLAND HOSPITAL TRUST COMPANY, its Successors and Assigns, forever, that certain parcel of land situated in the said Town, together with all buildings and appurtenances thereon, bounded and described as follows: Beginning at a point in the westerly line of road now, and formerly, on the northerly or formerly on the northeasterly end of the easterlymost curve of the northerly line of the road known as "Old Road" or "Old Road" running between the lines of line of Alder Road; and thence southerly, bounded northerly on the southerly end of the Road part, and in part by a curve concave to the east having a radius of one hundred (100) feet and a chord of 120' feet, bounded easterly by the lines of Progress Plot One in the Town of Charlestown, R.I. specifically part of ground F. E. & Ethel W. Kroker. Surveyed and Platted by S. T. Savage, R.L.S., of Providence, Rhode Island, and recorded in the said Town, a plot of which is recorded in the Land Evidence Records of the said Town in Book 2 at page 67, for a distance of one (1) foot and a boundary end (150) feet to the point of beginning of a curve concave to the east having a radius of one hundred (100) feet and a chord of 120' feet, bounded easterly, bounded westerly on said last mentioned lot, in part by a distance of one (1) foot and in part on a certain portion of "Lot 13" on said plat, for a distance of one hundred (100) feet, bounded northerly on the southerly end of the said road, for a distance of one hundred fifty (150) feet to the centerline, bounded easterly on the southerly end of the said road, for a distance of one hundred fifty (150) feet, bounded northerly on the other side (120) feet to the point of beginning of a curve, subject, however, to certain reservations and exceptions contained in a deed from Fred E. & Ethel W. Kroker to Vincent G. & Mary G. Kroker dated August 16, 1954 and recorded in Book 34 at page 250 of the said Land Evidence Records. together with all plumbing, lighting and heating fixtures, and equipment now, or hereafter attached to or located on said land, and all rights, privileges, easements, appurtenances and hereditaments thereunto belonging, its rents, issues, rents and dues to be received from the future or the capture of persons said premises or at any part thereof entered on any site of said land, and all rights of way, water courses, and all other rights of the mortgagors hereunto belonging to use and enjoy for the sole and absolute use of the same any at any time from this time and to last forever until a default exists hereunder. To HAVE AND TO HOLD the same with all appurtenances unto, and to the use of the said RIDE ISLAND HOSPITAL TRUST COMPANY, its Successors and Assigns, forever. And we the said mortgagors, and our heirs, executors, administrators and for our heirs, executors, administrators and consignors, covenant with the said RIDE ISLAND HOSPITAL TRUST COMPANY, its Successors and Assigns, that we are lawfully seized in fee simple of the said granted premises that the said premises are free from all encumbrances except as aforesaid without contest that good full power and authority we have to sell and convey the same in and manner as aforesaid without contention that the said RIDE ISLAND HOSPITAL TRUST COMPANY, its Successors and Assigns, are forever quit claimed of the said premises, and that we the said mortgagors, and our heirs, executors, administrators and assigns, will warrant and defend the same to the said RIDE ISLAND HOSPITAL TRUST COMPANY, its Successors and Assigns, against the lawful claims of all persons whomsoever, taxes, assessments and other annuities expense hereby secured as hereinafter provided. And for the consideration aforesaid, we the mortgagors respectively do hereby release all our rights of dowry and curtesy all our right title and interest in and to said granted premises unto the said RIDE ISLAND HOSPITAL TRUST COMPANY, its Successors and Assigns, forever. PROVIDED that if we said mortgagors, or our heirs, executors, administrators or assigns, shall pay unto you said RIDE ISLAND HOSPITAL TRUST COMPANY, its Successors or Assigns, the sum of eight Thousand Four Hundred & no100 ($8,400.00) Dollars with interest thereon and interest on overdue installments, in accordance with the provisions of this mortgage, then this indenture shall be null and void and of no effect, and the said RIDE ISLAND HOSPITAL TRUST COMPANY, or at its banking house in Warwick, Rhode Island, Rhode Island shall then pay all taxes, assessments, water rates and charges of any kind due upon said premises, and the said RIDE ISLAND HOSPITAL TRUST COMPANY, its Successors or Assigns, or any banking house of RIDE ISLAND HOSPITAL TRUST COMPANY, its Successors or assigns, in respect of this mortgage or mortgage debt, under whatever status now in force or may hereafter be in force, shall upon demand then, and shall perform all other covenants and conditions contained herein, then this deed shall as also said promissory note be null and void and absolutely be void to all intents and purposes hereafter. BUT IF DEFAULT shall be made in the payment of the indebtedness above mentioned at any time or on any installment or installment period at the time of the term or at any time the same are paid, then the said RIDE ISLAND HOSPITAL TRUST COMPANY, its Successors or Assigns, may at their option, and without notice, foreclose the said premises, or assessments water rates aforesaid thereof, or any part thereof, or by any other means, and the said RIDE ISLAND HOSPITAL TRUST COMPANY, its Successors or assigns as the most first become payable, or by any of either or them of either of the any part or any portion of it shall be at the once convenience of the said RIDE ISLAND HOSPITAL TRUST COMPANY, the covenants or conditions of this mortgage or of said note, or any of them shall be for the lawful use the said RIDE ISLAND HOSPITAL TRUST COMPANY, its Successors or Assigns, and they shall have the right to take possession of the premises, or any part thereof, and to enter into, or intend to be entered into, the house and buildings on said premises, and to sell the same, or any part thereof, as a whole or in several granted, or any part parts thereof, or any part pertaining subject to this mortgage in case of partial remise herein, and the said RIDE ISLAND HOSPITAL TRUST COMPANY, its Successors or Assigns, may sell the same, or any part thereof, and assigns at public venue, a bid to the public for and become by the purchaser at any such sale, and no other purchaser than any person who shall have the highest bid, and the said RIDE ISLAND HOSPITAL TRUST COMPANY, its Successors or Assigns, publishing the same at least once each week for three successive weeks in some newspaper published in Washington County Providence County, Rhode Island, and the said RIDE ISLAND HOSPITAL TRUST COMPANY, its Successors or Assigns, of said notice shall be continued, together with a notice of the adjournment or adjournments, at least once each week on the day of said notice or soon after, and as the attorney or attorneys of us the said mortgagors and our heirs, executors, adminis- trators or assigns (for that purpose by us appointed) shall have the right to deliver the purchase or purchasers at such sales or, made and sufficient deeds of the premises or parts of said premises in full seisin and simple; and that the said RIDE ISLAND HOSPITAL TRUST COMPANY, its Successors or Assigns, may make such sales, or sales, and recover from the purchase, or purchasers, also any interest then due on the same, together with all expenses, the cost of the exercise of these powers, or in any way connected and all other expenses, costs and charges of the sale, including the exercise of the enforcement of the mortgage, with any proceeding or action with whomsoever initiated concerning the enforcement of the encroachment of the mortgage, and the costs of the attorney or attorneys employed in the foreclosure of the mortgage, and of expenses and repairs, either there- fore paid by the said RIDE ISLAND HOSPITAL TRUST COMPANY, its Successors or Assigns, or then remaining unpaid, under- lying and outstanding on the premises, and the said RIDE ISLAND HOSPITAL TRUST COMPANY, its Successors or Assigns, aforesaid, together with a true and particular account of such sale or sales, expenses and charges, to us the said mortgagors or our heirs, executors, administrators and assigns, and the said RIDE ISLAND HOSPITAL TRUST COMPANY, its both in law and equity against us the said mortgagors, and the said heirs, executors, administrators and assigns, and all persons claiming said premises pro sold by so, from or under us, or from them or any of them.

368 And we the said mortgagors, for ourselves and for our heirs, executors, administrators and assigns, here- by covenant with and for the said RHODE ISLAND HOSPITAL TRUST COMPANY, its Successors and Assigns, that we or they will upon request execute such deed or deeds confirmatory of such sale or sales as may be necessary or advisable. AND FURTHERMORE, we the said mortgagors, for ourselves and for our heirs, executors, administrators and assigns, do hereby covenant with the said RHODE ISLAND HOSPITAL TRUST COMPANY, its Successors and Assigns that we will keep and will maintain in good and substantial repair and condition the grout and wall and roof granite walls; that insurance against loss by fire, and other such causes as may be specified by the mortgagor, its successors and assigns, shall be maintained on the buildings on the premises described in the mortgage, and that such policy or policies, or reconstruction insurances, shall be kept and maintained on the buildings on the premises afforded a sum not less than $60,000 or other sums in greater amounts will present the own appreciation of the property, and in such amount as is not less than $60,000 Dollars or in other sums in greater amounts will present the own of co-insurance clauses contained in such policy or policies, and that said policy or policies shall be held by said RHODE ISLAND HOSPITAL TRUST COMPANY, its Successors and Assigns, as collateral security, and that said RHODE ISLAND HOSPITAL TRUST COMPANY, its Successors and Assigns, may from time to time any time prior to any maturity which may exist in the mortgage deed, or at any time after the mortgage is paid, to bid and make any bid or bids as may be necessary to maintain
