CHARLESTOWN ESTATES, INC., a corporation duly incorporated under the laws of the State of Rhode Island, and having a place of business in the Town of Westerly, County of Washington and State of Rhode Island, for consideration paid grant to FLORENCE MURDOCH and ANNA J. LOYZE, both of Vernon, County of Tolland and State of Connecticut, as joint tenants and not tenants in common, meaning to the survivor, with WARRANTY COVENANTS. A certain tract or parcel of land situated at Quonocutting in the Town of Charlestown, County Washington and State of Rhode Island, being a part of a tract of land, and off set as a portion of the plat entitled, "Shorea Acres, property of Charlestown Estates, Inc., Concuttong, Charlestown, R. I.," shall be marked Land Evidence Book 24, page 441 of said Land Evidence, bounded and described, roughly, as follows: wit: Beginning at the southeasterly corner of the parcel herein conveyed at a point on the easterly line of Hoxie Avenue, as so called, said point being 75 feet northerly of the north-westerly corner of said Hoxie Avenue and the line of the street so called, thence running along the north-westerly corner of said line of Hoxie Avenue 125 feet to the north-westerly corner of the parcel herein conveyed; thence turning a right angle and extending easterly 257 feet more, or less to the north-easterly corner of the parcel herein conveyed; thence turning a right angle and extending southerly 125 feet more, or less to the south-easterly corner of the parcel herein conveyed; thence turning a right angle and extending westerly 257 feet more, or less to the point of beginning. In consideration of the purchase price it is understood and agreed that the following restrictions and reservations shall apply to and be binding upon the owners for a period of thirty years from January 1, 1946. The above conveyed premises shall be used for residence purposes only and as a site for only one dwelling house not to exceed six habitable rooms, provided that the dwelling be of a class not to cost less than three thousand (3000) dollars, to be built neither near Hoxie Avenue, also, on called, on the west side than the building line of houses and other buildings in the vicinity of said building called, the building shall approach the side lines or rear line nearer than five feet, no detached garage or other building or buildings shall be erected on said premises, all such buildings must be sanitary flush toilets, and all toilets and sinks must drain into a septic tank or cesspool. In consideration of the purchase price, the grantors, their heirs, executors, administrators and assigns, licensees, grantees and servants are granted a right of way 10 feet wide to construct and install all necessary pipes and cables in the street called Hoxie Avenue and Parcel "R" surrounding the lagoon as shown on a site plan for the purpose of using said land for laying the kegon for the purpose of gas, heat, and water, a right of way 10 feet wide to the grantors, their heirs, executors, administrators, assigns, licensees, grantees and servants are granted a right of way through Lots 154 and 155 and Page 1 in the Land Evidence Book 24, page 441 of said land for the purpose of passing vehicles, in common with others, said lots are shown on a certain plan or plat entitled, "Plat of East Beach, Concuttong, Charlestown, R. I." said plan being recorded in the Land Evidence Book 24, 1 inch equals 100 feet, revised July 1st, 1951. Which plat is duly recorded in the Land Evidence Records of said Town of Charlestown. In consideration of the above rights and privileges to cross and recross from the within granted premises to the highway, Charlestown Pond and the Atlantic Ocean the grantees, their heirs, executors, administrators, assigns, licensees, grantees and servants are granted a right of way, and the grantors, their heirs, harmless and blameless from any damage or liability of any kind or nature due to the use of said drives, streets, roads or rights of way as hereinbefore specified. The use of parcel "R" and Lots 154 and 155 shall be for the above purposes only.
