Schwartz and Mary N. Schwartz, husband and wife, both of Yonkers, State of New York, for consideration paid, grant to ROGER WILLIAMS SAVINGS AND LOAN ASSOCIATION, a Rhode Island corporation, located in Providence, Rhode Island, WITH MORTGAGE COVENANTS, to secure the payment of Eight Thousand and 00/100 Dollars ($8,000.00), with interest thereon, principal and interest being payable in monthly installments, all provided in a promissory note of even date herewith, and also to secure the performance and observance of all covenants and agreements herein contained. That real estate, together with all buildings and improvements now or hereafter erected thereon, and all plumbing, heating, lighting and other fixtures, equipment and articles now or hereafter attached thereto, situated in the Town of Charlestown, Rhode Island, and described as follows: Said real estate containing by estimation seventy-five (75) acres, more or less, and being bounded and described as follows viz:- Beginning at a stake on the westerly side of the Dune Highway at the northeasterly corner of the premises hereby conveyed and at the southeasterly corner of land now or formerly of Elizabeth H. Lenner, thence southerly, bounded easterly by said Dune Highway, to a wall at the southeasterly corner of the said premises, thence westerly to the northeasterly corner of land now or formerly of Frank Clark; thence westerly, bounded southerly partly by land now or formerly of Jack Koski, et ux., partly by land now or formerly of Joseph Wildner, and partly by land

226 now or formerly of Namme Tolveism, to a point six hundred and sixty-five (665) feet, east of the shore of Pasquint Pond; thence at right angles and northerly one hundred thirty-two (132) feet; thence at right angles and westernly six hundred and sixty-five (665) feet, to a point on a line running parallel to a certain line running thence at an angle of 45° south-westerly to the shore of said Pasquint Pond; thence following the shore of the said Pasquint Pond northerly to a point on a line running parallel to a line running northerly across the premises hereby conveyed, and the southwesterly corner of said land now or formerly of Namme Tolveism; thence easterly, bounded by land now or formerly of [?] and partly of one Lawrence [?] land now or formerly of Estate att Luttimans, et al., and partly by land now or formerly of said Lawrence [?] Luttimans et al., to the point of beginning, or however otherwise said premises may be bounded and described. The premises herein conveyed are the same premises as were conveyed by Antonia Salorano to Eugene J. Schwartz et ux, on event Date. The premises herein conveyed are subject to the agreements way of easements and records of entry. This mortgage is made under the STATUTE OF CONDITION and with the STATUTORY POWER OF SALE provided, however, that publication of a notice of a foreclosure sale may be made alternatively in a public newspaper published in the town where the premises are located or said foreclosure sale may be held upon the premises, or elsewhere as option of the mortgagee, as specified in said notice. This mortgage is made subject to those additional covenants and agreements contained in a STATEMENT OF COVENANTS AND RESTRICTIONS, executed this day by the mortgagor, the original text of which is recorded on said 2nd day of April, 1960 in land evidence book 37, page 225. So said covenants and agreements are made part of this mortgage, and if default shall be made in the performance or observance thereof it shall be a default for the mortgagor to the mortgage in toll the above described premises pursuant to said STATUTORY POWER OF SALE. And for the consideration aforesaid, we, Eugene J. Schwartz and Mary N. Schwartz, husband and wife, release to the mortgagees all our respective rights of curtesy and dower and all other rights, statutory or otherwise, in the aforesaid described premises.
