Browning, of Wakefield, County of Washington, State of Rhode Island, as Joint Tenants and not as Tenants in Common with WARRANTY COVENANTS (Description, and Incumbrances, if any) That certain real estate situated in Charlestown, County of Washington, in the State of Rhode Island, and described as follows: Those certain parcels of land, located in the Town of Charlestown, County of Washington and State of Rhode Island, laid out and designated as Lots Numbers 1060-1061-1062 shown on a "Map of Charlestown by the Sea, Charlestown, Rhode Island, owned and developed by Thomas P. Reilly, Scale 1" = 100 feet, dated July 25, 1954, in the office of K. W. Leighton, Civil Engineer, New Haven, Connecticut," and filed in the office of the Town Clerk of Charlestown. Said lots are bounded as follows: WESTERLY : by Killnorm Street, as shown on said Map, one hundred fifty (150) feet, more or less; NORTHERLY : by Lot #1063, as shown on said Map, one hundred (100) feet more or less; EASTERLY : by Part of Lot #1059c, as shown on said Map, forty-five (45) feet, more or less; SOUTHERLY : by Davernty Street, as shown on said Map, one hundred thirty-seven point ninety-seven (137.97) feet, more or less. THORP, both of the Town of Westerly, County of Washington State of Rhode Island, for consideration paid grant to HENRY S. LOCKWOOD and DOROTHY P. LOCKWOOD, husband and wife, both of the Borough of Manhattan, City of New York and State of New York, as joint tenants and not tenants in common, wanting to the survivor, with WARRANTY COVENANTS. A certain tract or parcel of land situated and located at Quonocutong Central Beach, so called, in the Town of Charlestown, County of Washington and State of Rhode Island, and bounded and described as follows, to wit: Beginning at a point on the southerly line of Boulder Avenue as outlined, said point being the northeasterly corner of the parcel herein conveyed and the northeasterly corner of the land of Henry S. Lockwood; thence easterly or northerly along the southerly line of Boulder Avenue sixty-five (65) feet to the northeasterly corner of the parcel herein conveyed; thence turning a right angle and extending southerly

Lockwood one hundred twenty-five (125) feet to the point and place of beginning; said land being a part of the land of former James M. Butler measuring 2.07 other of the lands estate, grantors solely by land of Robert P. Moginetski, et ux and westerly by land of Dorothy P. Lockwood. Meaning and intending to convey lot No 197 as shown and delimited on that certain plat in or plat entitled, "The Quonochontaug Beach Road as extended February, 1948, Charlestown, R.I., Property of H. E. and M. H. Thorp, scale 1 inch equals 80 feet, July 1948, signed R. L. Levin". Said grantors, their heirs and assigns shall have the right to pass and repass and to free and from and to said lot or tract or on foot or otherwise, over and on those certain eight right of ways as shown and delimited on the aforementioned plat and also on that certain plan or plat entitled, "Quonochontaug Beach Road dated October, 1924, revised September 1948, signed R. L. Levin" specifically the right of way leading southeasterly from the road to the front water, and any other portions of said plat which right hereafter be designated as right of ways, and said right shall be in common with the owners of the road then covenant and agree and with the said grantors, their heirs and assigns, that the said grantors, their heirs and assigns shall pay to Quonochontaug Beach Fire District, said District and its successors, and on its assignees, or on its heirs before the first day of August each year the sum of five dollars ($5.00) as an annual membership fee in said District, sum to be paid to the treasurer of said Quonochontaug Beach Fire District, its successors and assignees, in its and their unconventional directions and the said membership fee shall be in consideration of the said lot being designated for public use, and the said sums agreed to be paid are hereby made a lien and charge on said lot and the grantors hereby covenant and agree that said sum shall be paid within one year after the herby mentioned date of conveyance, and if the said sum shall not be paid the said sum shall become, due and lawful for the said Quonochontaug Beach Fire District, its successors and assignees, to be collected by the treasurer thereof at public auction, first giving notice of such sale in some newspaper published in said County of Washington at least once a week for two weeks prior to such sale and the premises not be sold to chesares at said sale. This conveyance is made and subject and accepted to the following conditions and restrictions: 1. In case of a contemplated sale of said lot or parcel of land or any part thereof; Howard E. Thorp and Nelson H. Thorp, their heirs and assigns shall be given ten days written notice in writing and shall have the first right of refusal to purchase the said land at the same price and terms and conditions offered in good faith and actually made and offered to said grantees, their heirs and assigns. 2. The above conveyed premises shall be used only as a site for one dwelling house on the lot hereby conveyed, which shall be built in accordance with the premises in accordance with the building lines as shown on said plat, and no other building, no out building, that said building line, as well as any building of any nature or kind whatsoever approach the said line, and no building shall be
