Know all men by these presents, that I John F. Kelly 2nd of Charlestown, Washington Co. State of Rhode Island in consideration of the sum of ten dollars to me paid by Samuel S. Kenyon of Charlestown, County and State aforesaid, the receipt hereof is hereby acknowledged, do hereby remise, release and forever quitclaim unto the said Samuel S. Kenyon his heirs and assigns forever, all the right title, interest property, claim and demand which I may have or have right of right ought to have or claim, in and to a certain tract or parcel of land bounded and described as follows viz: beginning at a point where the west line of land of S. S. Kenyon intersects north line of land of John M. honey running westerly on the line of said James and of David M. Assey to the Pawcatuck River, thence on said river to land of heirs of James & Joanna T. Hosie, following said heirs of Joanna T. Hosie's line to the highway, leading from Carolina to North over gravitation, thence Easterly on said highway to the Southwest corner of land of E. Kenyon, thence Northerly to point of beginning said property being the part of the farm lying on the North Side of the highway heretofore mentioned formerly belonging to heirs of Sophronia Kenyon and situated in the town of Charlestown R.I. To have and to hold the same with all the rights privileges and appurtenances thereunto appertaining, unto and to the use of the said Samuel S. Kenyon his heirs and assigns forever, And I the aforementioned John F. Kelly 2nd for myself and for my heirs, executors and administrators do covenant with the said Samuel S. Kenyon his heirs and assigns that I will warrant and defend the aforesaid premises unto the said Samuel S. Kenyon his heirs and assigns forever, against the lawful claims and demands of all persons claiming by, through or under me, In witness whereof I have hereunto set my hand and real seal this 25 day of march in the year of our Lord one thousand eight hundred and ninety nine, Signed and sealed in presence of John Co. 319 And we the said mortgagors do hereby, for ourselves and for our heirs, executors and ad- ministrators, covenant with the said mortgagees, its successors and assigns, that we are law- fully seized in the fee simple of the said grants presently granted to us and that we are duly empowered by selling and conveying the above described property, right full power and lawful authority to sell and convey the same in the manner as aforesaid; that the said mortgagees, its successors and assigns, shall and forever have all the right title interest and claim in the said premises as herein reserved, and that we the said mortgagors will, and our heirs, executors and administrators shall, warrant and defend the said premises to the said mortgagees, its successors and assigns, against all and every right claims and demands of all persons, except as aforesaid above. PROVIDED, NEVERTHELESS, that this conveyance is subject upon the express condition, that if said mortgagors, or their heirs, executors and administrators or assigns, shall pay unto the said mort- gagees, or their successors or assigns, the sum of Three Thousand (3,000) Dollars, together with the interest thereon in the manner as aforementioned, and the said sum and interest shall be paid into the mortgagees, its successors or assigns, the said mortgagees and bearing even date herewith; shall and also pay all taxes and assessments of every kind levied or assessed upon or in the said premises, and shall keep the said premises in good repair and condition, and in event of default of said mortgage which the said mortgagees, its successors or assigns, may be called upon to pay whether assessment taxes or any other charges, including but not limited to water, sewer, fire insurance premiums, water rates, and other sums, the payment of which are hereby secured, as well and when the same become due and payable, prior to the date of maturity of the said note, the said mortgagees, its successors or character for which said mortgagors may become liable or indebted, directly or indirectly, to said mortgagees, prior to the date of maturity of the said note, then and in that event, any of the aforementioned covenants and conditions contained in this instrument, then this deed shall also be said promissory note shall become and be absolutely void to all intents and purposes. IN EVENT OF DEFAULT in the payment of any of the said promissory note according to the terms thereof or as herein mentioned or any other sum or sums, including insurance premiums or water rates herein However otherwise described being one of the property now owned by the Grantor in the said Town of Charlestown. Together with all rights of way and easements appertaining to the within described property, and particularly the right of way or easement granted to this Grantor by John H. Higgins by instrument dated May 4, 1928 and recorded in the Records of Land Evidence by the said Town in Mortgage Book 15 at page 211 and 212. This conveyance is made subject to all rights of way and easements affecting the within granted premises and subject to a mortgage to Industrial National Bank and to taxes assessed as of December 31, 1977.
