290 STATUTORY FORM OF WARRANTY DEED. CHARLESTOWN ESTATES, INC., a corporation duly incorporated under the Laws of the State of Rhode Island, and having a place of business in the Town of Westerly, County of Washington and State of Rhode Island, for consideration paid grant to N. ALFRED COLLINS and GRACE M. COLLINS, as husband and wife, both of Manchester, County of Hartford and State of Connecticut, as joint tenants and not tenants in common, meaning to the survivor, with WARRANTY COVENANTS, A certain tract or parcel of land located on the southerly side of Ocean View Avenue, so called, as appears on the plat of "Ocean View Beach" in the Town of Charlestown, County of Washington and State of Rhode Island, bounded and described as follows, to wit: Beginning at a point on the southerly line of Ocean View Avenue, so called, said point being the northeasterly corner of the parcel herein conveyed and the northeasterly corner of a parcel conveyed to Mrs. Sarah G. Barber, et al unless otherwise described at right angle to the southerly line of Ocean View Avenue one hundred twenty-five feet; thence turning a right angle and running southerly along the easterly corner of the parcel herein conveyed, said point also being the southeasterly corner of said Barber land; to thence turning a right angle and extending westerly along the southeasterly corner of the southerly boundary of the parcel herein conveyed, thence turning a right angle and extending northerly one hundred twenty-five feet to the northeasterly corner of the parcel herein conveyed, thence turning a right angle and extending northerly one hundred twenty-five feet to a point on the southerly line of Ocean View Avenue; thence extending along the southerly line of Ocean View Avenue northeasterly to the point of beginning. The parcel herein conveyed is bounded northerly by said Ocean View Avenue, easterly by said Barber land and southerly and westerly by lands of the said grantor. Meaning and intending to convey the westerly thirty (30) feet of Lot #408 and the easterly thirty-five (35) feet of Lot #407 of said map and delineated on the sheet marked "Beach, R. I., property of S. H. Davis, Leon L. Rolland, C. E., 100 to the Evidence" certain plat and map of Ocean View Beach, prepared by Roland H. Brandeis at thoroughing beach, R. I., property of S. H. Davis, Leon L. Rolland, C. E., 100 to the Evidence recorded in the Land Evidence Records of said Town of Charlestown, February 2, 1936. The above conveyed premises shall be used as a single family residence, and no other building shall be erected on the lot save for a closet or site for only one residence, said residence shall be built in accordance with the building line which is twenty-five (25) feet from the street line of Ocean View Avenue. No building shall be permitted to be built on the lot except along the street nearer the southern portion of the house unless the building is set back from the building line, and no portion of any building erected on this lot shall approach the side lines of the lot closer than ten (10) feet. No detached garages, accessory buildings or buildings shall be erected thereon, and all toilets must be built as sanitary flush toilets. In the absence of toilets, toilets must drink into a septic tank or tankas or suitable cesspool. In consideration of the purchase price hereof it is understood and agreed that the above restrictions and reservations shall be coy to run with the land for a period of twenty years from January 1, 1953. The grantees, their heirs, executors, administrators, assigns, licensees, servants or agents shall have the right of way, in common with others to cross and recross Lot #439s from Atlantic Avenue to the beach, and the grantees, their heirs, executors, administrators, and agents, shall have the right of way, in common with others to cross and recross Lot #439s for all purposes over that certain lot others to cross and recross Lot #439s for all purposes over that certain lot #538 and the 25 foot right of way leading to said lot, all as shown on that certain plat or map of Ocean View Beach, prepared by Roland H. Said plat is duly filed in the Land Evidence Records of said Town of Charlestown.
