241 LEWIS P. LATHAM and wife, MARGARETTA W. LATHAM in the State of Rhode Island, for consideration paid, grant to ROGER WILLIAMS SAVINGS AND LOAN ASSOCIATION, a Rhode Island corporation, located in the City of Providence in said State, with MORTGAGE COVENANTS, to secure the payment of Twelve Thousand and no/100 Dollars ($12,000.00), with interest thereon, principal and interest being payable in monthly installments, all as provided in a certain promissory note of even date herewith, and also to secure the performance and observance of all covenants and agreements herein contained, That certain real estate, together with all buildings and improvements now or hereafter erected thereon, all the betriments, appurtenances and rights thereunto belonging or in any wise now or hereafter appertaining, the rents, issues and profits thereof, and all plumbing, heating, lighting and other fixtures, equipment and articles now or hereafter attached thereto, situated in the Town of Charlestown in the State of Rhode Island and bounded and described as follows: A certain tract of land in the Town of Charlestown, Rhode Island, containing by estimation two acres, more or less, with the George House, so called, and all other buildings and improvements thereon, said tract of land is known as "Benjamin S. Oman House Property" and is bounded: northerly partly by land now or formerly of Benjamin S. Davis and partly by land now or formerly of Charlestown Pond and westerly by the highway leading from Post Road to the said Pond. This mortgage is made upon the STATUTORY CONDITION and with the STATUTORY POWER OF SALE, provided, however, that a foreclosure sale under the STATUTORY POWER OF SALE may be held upon the premises or elsewhere at the option of ROGER WILLIAMS SAVINGS AND LOAN ASSOCIATION. And we, the said mortgagors, for ourselves and for our heirs, executors, administrators and assigns, covenant and agree with the mortgagee and its successors and assigns to maintain all buildings upon said premises in good repair and not to cause or permit waste or the demolition or removal of any of said buildings and to permit the mortgagee and its successors and assigns and its due and authorized officers and agents to enter upon said premises at all reasonable times to inspect the same, and this mortgage is made upon the further condition that this covenant shall be kept and performed and if default shall be made in the performance or observation thereof then it shall be lawful for the mortgagee to sell the above described premises pursuant to said STATUTORY POWER OF SALE. And for the consideration aforesaid, we, Lewis P. Latham and Margaretta W. Latham, do hereby release all our right of curtesy and dower and all other rights, statutory or otherwise, in the aforesaid described premises. WITNESSED our hands this 19th day of March, 1958.
