308 To all People to whom these presents shall come One Henry N. Taber and Abby S. Taber wife of said Henry N. of Charlestown in the county of Washington and state of R.I. Send greeting, Know ye that we the said Henry N. & Abby S. Taber (hereinafter called the grantors) for our in consideration of the sum of Three Hundred Dollars in cash hand before the sealing hereof well and truly paid by George La croix of said Charlestown the receipt whereof we do hereby acknowledge and are therewith fully satis facted and paid, and Thereof and of every part and parcel Thereof do execute acquit and discharge the said George La croix his heirs successors and administrators forever by these Presents, have given granted bargained sold assigned transferred conveyed and confirmed And by these presents do hereby fully and absolutely give grant bargain sell assign transfer convey and confirm unto the said George la croix (hereinafter called the grantee) his heirs and assigns forever, A certain lot of land situated in said Charlestown with a dwelling house thereon standing bounded and described as follows beginning at a stake and stone by the East side of the highway leading from town house white to the Salt Pond, thence running Eastward thirty feet thence Southerly a hundred five with said highway ninety feet Thence Westerly ninety feet to said highway, thence by said highway ninety five to the place of beginning, bounding Westerly on said highway Northerly Easterly and Southerly on land of Cohalan tvers or however bounded, To have and to hold the said granted and bargained premises, with all the ap purtenances privileges and commodities to the same belonging or in anywise appertaining to the said grant his heirs and assigns forever, to his and to their own proper use benefit and behalf forever. And we the said grant for ourselves our heirs executors and administrators do covenant promise and grant to and with the said grantee his heirs and assigns, that at and before the sealing hereof we are the true sole and lawful owners of the above bargained premises and are lawfully seized and possessed of the same in our own proper right as good perfect and absolute estate of inheritance in fee simple; and have in ourselves good right full power and lawful authority to grant bargain sell convey and confirm the said bargained premises

in manner as aforesaid. And that the said grantee his heirs and assigns shall and may from time to time, and at all times hereafter, by force and virtue of these presents, lawfully, peaceably, and quietly have hold, use occupy possess and enjoy the said demised and bargained premises with all the appurtenances free and clear, and freely and clearly acquitted, exonerated and discharged of all and all manner of power or other gifts, grants, bargains sales, leases, mortgages, wills, entails, jointures, dower judgments, executions and encumbrances, of what nature or nature ever, that might in any measure or degree obstruct or make void this present deed, Furthermore we the said grantors for ourselves our heirs, executors and administrators, do covenant and engage the above demised premises to the said grantee his heirs and assigns against the lawful claims or demands of any person or persons whosoever, forever to warrant same and defend by these presents. The condition of this deed is such that whereas we the said Henry M. Allen and Abby S. Allen have executed our negotiable promissory note for the sum of three Hundred Dollars being with date herewith and made payable to the order of George L. Cross on demand with interest at the rate of five per centum per annum payable semiannually till said principal sum is paid whether at or after maturity, and all installments of interest in arrears whether before or after maturity be then interest at the rate aforesaid till paid Now therefore, if we the said grantors or our heirs executors, administrators or assigns, or any other person for us or for them, shall pay said note at maturity together with the interest thereon according to the tenor thereof then this deed shall be void, otherwise shall be and remain in full force and effect. Furthermore we the said grantors do hereby, constitute and appoint the said grantee his executors, administrators and assigns an Attorney irrevocable and with full powers of substitution and revocation for us and in our name or in his or their name or names at any time in case default shall be made in the payment of said note, or of the semiannual interest due thereon or breach shall be made of the covenants of Insurance hereinafter contained, and such default or breach,

shall continue for the term of ten days, to sell at publick auction the premises aforesaid, or any part thereof; they first giving, after the expiration of said term of ten days, twenty days notice. If such sale shall be some of the publick newspapers printed in Providence, Rhode Id, and in [illegible] or in their names, to make, execute, seal, acknowledge and deliver to the purchaser or purchasers thereof any deed or deeds that may be necessary to vest in such purchaser or purchasers, a full just and absolute estate in fee simple therein, and of said thereof; thereby granting unto said Attorneys power to continue or adjourn such sale from time to time and we do authorize said attorneys, to receive the amount of the sums may be sold for, and after the payment of all the expenses incident to such sale, to absolutely and absolutely distribute the residue thereof to the payment of the amount of principal and interest of said note hereby secured, (and we hereby agree that in case we do not pay the same in full by payment of semiannual interest, and the said covenants of insurance, the principal of said note shall be deemed due and payable on the day of such sale,) accounting to us or our heirs and assigns, for all sums over and above the amount thereof we hereby satisfying, confirming and conforming such sale or sales as may be made or caused to be made by virtue hereof. Furthermore we, the said grantors for ourselves and for our heirs, executors, administrators and assigns do hereby covenant with the said grantee, his heirs and assigns that Insurance against forcible fire shall be kept and maintained upon the buildings on the premises aforesaid, in a sum not less than seven Hundred Dollars. And that the policy or policies of such Insurance shall be assigned and transferred to the said grantee his heirs and assigns as collateral security hereto, and in default thereof we do hereby agree that the said grantee his heirs or assigns may effect such Insurance, and premiums or premiums thereon shall be a further lien upon the said estate added to the amount of said note and secured by these premises.
