404 That certain parcel or tract of land, together with the buildings and improvements thereon, containing by estimation twenty-five (25) acres, more or less, situated in the Town of Charlestown, County of Washington state of Rhode Island, bounded and described as follows: BEGINNING at a point at the northeasterly corner of the premises hereby conveyed on the southerly side of a public highway or private road to Pasquestow Pond; said point being 425 feet easterly from the State highway then known as "Old Post Road" or "Trail", thence running southwesterly by said highway a distance of 1300 feet, more or less, to a stone wall, thence running westward along said stone wall a distance of 100 feet, more or less, to a stone wall, thence running southerly along said stone wall a distance of 200 feet more or less, to a stone wall, thence running easterly along said stone wall a distance of 100 feet and turning westerly, also running said last mentioned stone wall, a distance of 200 feet more or less, to a stone wall, thence running southerly and turning easterly along said stone wall a distance of 345 feet, thence turning and running in a northeasterly direction to a stone wall, a distance of 235 feet more or less, to a stone wall, thence running along a wall, a distance of 345 feet, thence turning and running in a northeasterly direction to a stone wall, a distance of 235 feet more or less, to a stone wall or stone bound set in the ground, thence turning and running, maintaining a distance of 25 feet from said stone wall, in a northeasterly direction to a stone wall, thence running a distance of 569 feet more or less, to the point of place of beginning; or however else the same may be bounded or described. Being the same premises conveyed to the mortgagors by deed of Lauri M. Rossi et ux dated June 23, 1955, recorded in Book 29, at page 372 of the Charlestown Land Evidence Records; TOGETHER with the right of ways and privileges and SUBJECT to the conditions contained in said deed. TOGETHER with a parcel of said land 50 by 200 feet, being southwest on the street side of said Pasquestow Pond, conveyed to these mortgagors by deed of said Rossi et ux dated December 23, 1954, recorded in Book 29, at page 655 of said Land Evidence Records; TOGETHER with the right of way and SUBJECT to the restrictions contained therein. This mortgage is made upon the STATUTORY CONDITION and with the STATUTORY POWER OF SALE; provided, however, that publication of notice of a foreclosure sale may be made substantially in the words following: "Notice is hereby given that in the City of Providence, and that a foreclosure sale may be held upon the premises or elsewhere at the option of the mortgagee, as specified in said notice." This mortgage is made subject to all additional covenants and agreements contained in a STATEMENT OF COVENANTS AND AGREEMENTS, a copy thereof having this date been received by the mortgagor, the receipt whereof the mortgagors hereby acknowledge; said covenants are recorded in Book 29, Land Evidence in Book 34, at page 40. Said covenants and agreements are hereby by reference made part of this mortgage, and if default shall occur in the performance of any of the covenants or obligations of any of the same, it shall be lawful for the mortgagee to sell the above described premises pursuant to said STATUTORY POWER OF SALE. And for and the consideration aforesaid we, swd mortgagors, release to the mortgagee all right of dowry (&curtesy) and all other rights, statutory or otherwise, in the aforesaid described premises.
