Warranty Deed
We, FRED E. KROKER and ETHEL W. KROKER, husband and wife, of Mayfield in the County of Bristol in the Commonwealth of Massachusetts, grant and convey unto Louis DeFazio Dr. and Julia DeFazio, his wife, of 76 Nutledge Road, Bethelfield, Connecticut, for the sum of One Dollar ($1.00) and other good and valuable consideration,
with Warranty Covenants the land situated and lying in the Town of Charlestown in the State of Rhode Island, laid out and delineated as follows:
Lot Four-Hundred and Sixty (460)
on that plat entitled, "OCEAN RIDGE Plat Six" in the Town of Charlestown, R.I., Property of Fred E. and Ethel W. Kroker, Surveyed and platted [?] August, 1955; (witness E. Eastman, Engineer, whose plat is on record in the Office of the Town Clerk of the Town of Charlestown, in the Land Evidence Records) together with the right to use the roads and streets as they are laid out upon the plat heretofore referenced and together with the right to use in common with others, the way (forty feet) in width designated as "Private Right of Way" and the park and boat landing laid out and designated as "Park and Boat Landing" use that platted entitled, "Ocean Ridge Park and Boat Landing" recorded in the said Office of the Town Clerk or Book Plat 2 at page 84
and in the Office of the Town Clerk of the Town of South Kingstown in said State in Plat Book 84 on page 82.
But reserving reservations, to themselves and their grants and heirs the right to install in the roads and streets, telephone and electric poles line or conduits, gas pipes and water mains, sewer and drainage pipes and other utilities. The grantors further reserve the right to install and maintain the necessary service of the land hereby conveyed and for adjoining and adjacent property. The grantors further reserve the right to assign the rights and reservations herein contained to any person, firm or corporation for the purpose of the installation and maintenance of the same. (The property is subject to the State Taxes of Record Taxes of Record, liens, person, firm or corporation for the purpose of the installation and maintenance of the same.)
The herein described premises are conveyed subject to the following restrictions:
(a) There shall be no building extending beyond the building line designated on the plat. (b) No building shall be erected on the property (except as provided in Item 2) from the most easterly boundary of the lot (Item 5) from the most westerly boundary of the lot (Item 5) from the north boundary of such lot and from the most southerly boundary of such lot. (c) All buildings constructed on the property shall be for one family residential use only. (d) No building shall be used for any purpose other than as a single family residence. (e) No building shall be used for any commercial purpose. (f) No building shall be used for any purpose other than as a single family residence.
