588 Warranty Deed
We, FRED E. KROKER and ETHEL W. KROKER, his wife, of Mansfield in the County of Windham in the Commonwealth of Massachusetts, for consideration paid, namely to Adamo Martorelli and Adele V. Martorelli, his wife, of 21, Clinton Street, Stafford Springs, Connecticut, the sum of One Dollar ($1.00),
convey the land situated and lying in the Town of Charlestown in the State of Rhode Island, laid out and delineated as
Lot Three-Hundred and Eighteen (318)
on this plat entitled, "OCEAN RIDGE Plat Two" One in the Town of Charlestown, R.I. Property of Fred E. and Ethel W. Kroker, Surveyed and [?] July, 1954 Willard R. Easterbrook, Engineer, which plat is on record in the Office of the Town Clerk of the Town of Charlestown, in Plat Book 4 page 4.
To have and to hold the same hereunto to hold in common with others, the way (forty ft) in width designated as "Private Right of Way" and the park and boat landing laid out and designated as "Park and Boat Landing" upon that plat entitled, "Ocean Ridge Park and Boat Landing" recorded in the said Office of the Town Clerk in Charlestown Plat Book 4 page 4 and in the Office of the Town Clerk of the Town of South Kingstown in said State Plat Book 84 page 92.
But reserving, nevertheless to the grantors, their heirs and assigns the right to install in the roads and streets, telephone and electric poles or conduits etc. and to maintain the same. The grantors further reserve the right to use the roads and streets, telephone and electric poles or conduits etc. for the purpose of providing water, fuel, gas and sewer water etc. to their remaining land. The grantors further reserve the right to use the convenient or necessary roads or pathways for the purpose of servicing, repairing, cleaning, or otherwise adjusting and maintaining the properties. The grantors further reserve the right to use the assignment of the said easements to any person, firm or corporation for the purpose of servicing the properties.
The above described servitude is subject conveyed to the following restrictions:
(a) There shall be no building erected on any lot (except a dwelling house and its appurtenances) on any part of the lot (except a Twenty (20) feet from the boundary of the parcel or Eighty (80) feet from the road). (b) No building shall be erected on any lot (except a dwelling house and its appurtenances) on any part of the lot (except a Twenty (20) feet from the boundary of the parcel). (c) There shall be no erecting of any structure of wood, stone or masonry of any kind (except a dwelling house and its appurtenances) on any part of the lot (except a Twenty (20) feet from the boundary of the parcel). (d) All buildings shall be constructed of fire resistant materials. (e) No building shall be used for any purpose other than a single family dwelling house and its appurtenances. (f) No building shall be used for the purpose of any business, trade or profession. (g) No building shall be used for the purpose of any store, shop, garage or temporary building shall be used for dwelling. (h) No building shall be used for the purpose of any hotel, motel, boarding house, tourist camp or trailer park. (i) No building shall be used for the purpose of any club, lodge or similar organization. (j) No building shall be used for the purpose of any church, chapel or similar organization. (k) No building shall be used for the purpose of any school, college or similar organization. (l) No building shall be used for the purpose of any hospital, clinic or similar organization. (m) No building shall be used for the purpose of any office, studio or similar organization. (n) No building shall be used for the purpose of any factory, mill or similar organization. (o) No building shall be used for the purpose of any warehouse, storage house or similar organization. (p) No building shall be used for the purpose of any laundry, dry cleaning or similar organization. (q) No building shall be used for the purpose of any garage, parking lot or similar organization. (r) No building shall be used for the purpose of any gas station, filling station or similar organization. (s) No building shall be used for the purpose of any restaurant, cafe or similar organization. (t) No building shall be used for the purpose of any theater, cinema or similar organization. (u) No building shall be used for the purpose of any dance hall, ballroom or similar organization. (v) No building shall be used for the purpose of any gym, health club or similar organization. (w) No building shall be used for the purpose of any pool hall, billiard room or similar organization. (x) No building shall be used for the purpose of any gambling house, betting shop or similar organization.
