319 To all People to whom these Presents shall Come. We Ellison Sinkham and Franklin Mitchel of Burrillville in the State of Rhode Island Send Greeting. Know Ye. That we the said Ellison Sinkham and Franklin by this Indenture for in and consideration of the sum of in hand before the censeiling hereof well and truly paid by thousand Hundred and Seventy of Rhode Island currency in said state sixty thousand dollars to Roundland Shepard his the receipt whereof we do hereby acknowledge and waive with fully satisfied contented and paid, and thereof and of every part and parcel do hereby sell convey alienate and discharge over the said Roundland Shepard his do henceforth excuse acquit and discharge over the said Roundland Shepard his heirs, executors and administrators forever have given granted bargained sold alienated conveyed conferred and conveyed and by these presents do freely and fully and absolutely give grant bargain sell alienate convey confirm and convu Roundland Shepard his heirs and assigns forever Roundland Shepard his their lots and assign forever One tract of land with the mill, dwelling houses and other buildings and improvements mentioned shore situated partly in the town of Burrillville and partly in the town of Glocester in said state and on the both sides of the Ten Mile River known as the Cassina Mill Site together with the stream above named and river and all the appurtenances thereto and together also with all water ways water privileges, water rights and privileges, right of way quarrying or Excavating and all other rights and privileges belonging or appertaining to the said Mill and estate as per any last survey together also with the Sloan house, furniture and all machinery feed and materials, tools and all appurated of every kind and store and office furniture and fixtures and all other property found wherever owner belonging to or used in connection with said Mill estate having been land estates, land rights and privileges conveyed to us by Roundland Shepard and said Roundland Shepard the Deed bearing date Nov. 1st 1847 and informed hereby made to said deed for more full and particular description of the lands estates land rights, namely conveyed and transferred to be conveyed together also with all shakings tolls and furniture which may hereafter have on or use in connection with said Mill estate in the Town of the now there To have and to hold the said granted and bargained premises with all the appurtenances privileges and commodities to the same belonging or in any wise appertaining to have and belonging to the said Roundland Shepard heirs and assigns forever to have and belonging to the said Roundland Shepard his heirs and assigns forever to be held by them and their heirs and assigns forever. And we the said Ellison Sinkham and Franklin Mitchel do covenant promise and grant to the said Roundland Shepard his heirs executors and administrators forever beirs and beings that he and all manner of persons or grants in their own proper right more as perfect and absolute estate of inheritance province and serve and’ furthermore that he and all manner of persons or grants in their own proper right more as perfect and absolute estate of inheritance in fee simple and have in and good right full power and lawful authority to grant bargain sell convey and confirm the said bargained premises in presence as aforesaid. And that the said Roundland Shepard his heirs and assigns forever quite possess only occupy and peace enjoy and the said demised and bargained premises with all the appurtenances from our free and clear and liberty quietly enjoyed excavation and extinguished of said fold and all manner of former or other grants sole legacies sale mortgages writs of execution and all other claims whatsoever and that we will warrant and defend the said premises against all right claims or move make void present deed. except existing rights of way quarrying or Excavating over said lands Furthermore we the said Ellison Sinkham and Franklin Mitchel do covenant promise and grant to the said Roundland Shepard his heirs executors and administrators do covenant and engage we shall defend premises to claim the said Roundland Shepard his heirs and assigns against the claimL demands or money or promise payment whoever forever to warrant and defend by these presents except as to said rights of way quarrying or excavating in further April one 1848. Mitchel wife of said Franklin Mitchel in consideration of the sum of five hundred dollars paid to her’s below release and forever quitclaim into the said Roundland Shepard his heirs and assigns all my right title and interest to the and the aforementioned premises The condition of this deed is such that whereas the said Ellison Sinkham and Franklin Mitchel have promised our certain fine negotiable promissory notes for the sum of four thousand

320 dollars, six thousand dollars, ten thousand dollars, twenty thousand dollars and twenty thousand dollars, bearing an date forward and made payable to the said Jonathan Hazard or order in one, two, three, four and five years respectively in interest timely sufficient at the rate of seven per centum per year annuum His aforesaid wife of the said case Gideon Sullivan and Jonathan Hazard Mortgage or their heirs, executors, administrators or assigns or any other person for who or whom shall pay said notes of money together with the interest thereon according to the tenor thereof, this deed shall be and utmost whereas that he shall remain in full force and effect Furthermore as the said Gideon Sullivan, Jonathan Stafford Ashby A. Singleton and Jonathan Hazard do hereby grant release and appoint the said Jonathan Hazard his residents, administrators and assign our attorneys lawful full power with full power of substitution and revocation for us and in our names or in others names or means at any time or times if in default she shall be made in the payment of either of said notes or of the stipulated interest there on therefore or should shall be made of the covenants of insurance herein of this contained, and such default or breach is shall continue for the term of one year date, to sell at public auction the premises aforesaid or any part thereof, but first giving notice after the expiration of said term of one day's date, timely saying such date of sale some in one of our houses near the premises published in the date of Conveyance in our state and in our names or in others name to make, to make, appoint, deed, sale and conveyance and deliver to the purchaser or purchasers thereof, any deed or decree that may be necessary to ratify for such purchasers or purchasers full and absolute estate in fee simple forever and or sale thereof hereby granting unto said attorneys forever to continue adjourn such sale from time to time (in do authorize said attorneys to arrange price the amount the same may be sold for and after the payment of all the expenses incident to such sale or sales to apply and apply the received money to the payment of the amount of principal and interest of said note hereby secured in that agreeing that in case a sale be for default in the payment of the said amount or for nonpayment of interest or for breach of covenants of insurance or for nonperformance of any of said notes the purchase of all said notes shall be deemed true and paid in full on the day of such sale) warranting to us to our heirs and assigns for all some over and above the amount thereof us to be lawfully ratifying and confirming such sale or sales as may be made or cause to be made by ratifying others hereby we the said Gideon Sullivan and Jonathan Stafford Ashby for ourselves and for our heirs, executors, admin estates and assigns, the premises aforesaid lease to be free from all maintained upon the buildings or premises or encumbered in a sum not less than forty thousand dollars and that the policies of insurance shall be assigned and transferred to the said Jonathan Hazard and assign as collateral security hereby and in default thereof to secure agree that the said Jonathan Hazard or assigns may just levy such recovery and take the premises or premises paid thereon shall be further lien upon the said estate added to the amount of said notes and cause the same to be paid and the said Gideon Sullivan and Jonathan Stafford Ashby for ourselves and our heirs, executors and administrators covenant warrant such said Jonathan Hazard his heirs and assigns at any time and from time to time here hereafter to execute and deliver to him some other and further assurances or conveyances as he may from time to time as necessary (Continued on page 321)
