WHEELOCK, of West Hartford, County of Hartford and State of Connecticut, for consideration paid grant to JAMES J. KIRBY, Jr. and EUNICE G. KIRBY, husband and wife, both of the Town of Westerly, County of Washington and State of Rhode Island, as joint tenants and not tenants in common, meaning to the survivor, with WARRANTY CONVEYANTS. Two certain contiguous tracts or parcels of land located on the easterly side of Uplands Road, in called, at Quonochontough Beach, in the Town of Charlestown of County of Washington and State of Rhode Island, and bounded and described as follows, to wit: Lots #74 and #76 as shown and delineated on a certain plan or plat entitled, "Plat of Quonochontough Highlands at Quonochontough Beach, R. I., property of S. S. Davis, Esq." dated December 15, 1935, and recorded Feb. 1936, said plan being duly filed in the Land Evidence Records of said Town of Charlestown. Said two lots being situated on the easterly side of Uplands Road, one hundred twenty-five (125) feet in depth and one hundred seven (107) feet, more or less in width on the road and extending easterly therefrom and east, containing (including constructed porch) each lot bounded on the north by Lot #75, and on the south by Lot #77, both as shown on said plat, and on the east by the property of Edgar E. Coddington, northerly and southerly by land of Charlestown Estates, Inc. and easterly by land of Norman A. and Alice D. Lawrence. The above conveyed premises shall be used as a site for not more than one residence on each platted lot hereby conveyed, said residences to cost not less than one thousand dollars and to be in accordance with the building line which is twenty feet from the center line of Uplands Road. No portion of any house (including porch) shall approach the street nearer than the building line and no portion of any other building shall be constructed nearer than three feet to the boundaries of the lot on which it is constructed nearer than three feet. All toilets and sinks must be sanitary flush toilets and all toilets and sinks must drain into a septic tank or suitable cesspool. In consideration of the purchase price the grantees understand and agree that the above restrictions and reservations shall apply to and run with the land for a period of twenty years from January 1, 1955. The grantees, their heirs, attorneys, administrators, assigns, licensees, servants or agents shall have the right in common with others to cross and access lot #69 from Atlantic Avenue to the beach, and the grantees, their heirs, attorneys, assigns, licensees, servants or agents shall have the right in common with others to cross and re-cross at all times and for all purposes other lots, specifically lot #35 and twenty-five (25) feet of the easterly side of said lot #35, as shown on that certain plan or plat entitled, "Plat of East Beach at Quonochontough Beach, R. I., property of S. S. Davis, Esq." dated July 1, 1935, which plat is duly filed in the Land Evidence Records of said Town of Charlestown. Being the same premises conveyed to this Grantor and William C. Wheelock, Jr., as joint tenants by deed dated September 18, 1953 and recorded in the Land Evidence
