320 KNOW ALL MEN BY THESE PRESENTS, that We, Wilson D. Maine and wife, Belva B. Maine, both of the Town of Westerly and County of Washington and State of Rhode Island, for consideration paid, grant to Robert K. Finlayson, of the Town of Charlestown, Rhode Island, with WARRANTY COVENANTS That certain tract or piece of land, together with dwelling house and appurtenances thereon, situated at Quonochontouchag Beach, in the Town of Charlestown, County of Washington and State of Rhode Island bounds, and described as follows: to wit, Beginning at the most easterly corner of said land at a point in the town highway which is the most northerly corner of land now or formerly of Salvatore Castaldo, thence running southeast, bounded on the southeast by said Castaldo land, to a point one hundred twenty-five (125) feet from the point of beginning, thence turning at a right angle and running southeast, bounded on the southeast by other land of the grantors, forty-five (45) feet to a point, thence turning at a right angle and running northeast, bounded on the northeast, east, bounded on the northeast by other land of the grantors, along a line parallel with the said line which bounds the said Castaldo land, to a point in the said highway, thence along the said highway forty-five (45) feet to the point of beginning. And with the following explanations and limitations, being the same as these grantors had in their deed when they acquired the property. Said lot is: the greater part of lot 92 on assessors' plat 10 of the Town of Charlestown, and is approximately the most easterly quarter part of that tract or piece of land between the Beach (leading from the Ocean to a salt pond) and the said town highway, conveyed by Alfred O. Vars and his wife, Jane P. Vars to Frank A. Matthews and his wife, Susan E. Matthews by deed dated October 16, 1905, and recorded in Book 15 at Page 236 of the Records of Deeds in the Town of Charlestown. A strip of land extending from the said town highway to the southwest line of the land hereby conveyed, ten (10) feet wide, one-half of which (a strip five feet in width) is, at the northwest boundary of the land hereby conveyed and the other one-half of which (a strip five (5) feet in width) is on the land of the grantors to the northwest of the land hereby conveyed, is hereby declared to be laid out as a road or way for passage on foot or with motor and other vehicles and horses and for the use and maintenance of underground drains, sewers, water pipes, gas pipes and conduits and overhead wires and poles, along and over the northeast boundary of the land hereby conveyed, and the grantors accordingly reserve an easement and right of way in and to that one-half said strip (five (5) feet in width) which is on the land hereby conveyed and grant an easement and right of way in and to the other one-half said strip (five (5) feet in width) which is on the said land of the grantors for the purposes aforesaid for the benefit of the grantors and grantees respectively. The grantors further grant a right to pass and repair on foot and over along and that lot or parcel of the grantors' land forty-five (45) feet in width lying to the southeast of the land hereby conveyed, bounded by lines which are extensions of the northwest and southeast boundaries to the said breach. The grantors covenant that no building or construction to view or passage will be placed on the said lot or parcel lying to the southwest, and grant the right to moor or tie up boats along the water front of said lot or parcel. The grantors reserve to themselves and all others who now use and maintain underground pipes, conduits, sewers and drains on the premises hereby conveyed the right and easement to such use and maintenance in the places and along the courses as now laid, together with the right and easement to repairs, replace and remove the said pipes and conduits and to enter and excavate the land hereby conveyed at reasonable times and in a reasonable manner for such purposes.

321 The land hereby conveyed and the rights and easements hereby granted are subject to the restriction and condition that no commercial use shall be made of the same. The grantors release to the said grantees all their respective rights of dower and curtesy and all other interest in the afore described premises. WITNESS OUR HANDS this 19 day of October, 1954.
