Tucker for and in consideration of the sum of Three Thousand Dollars in hand before this deed enrolling herewith well and truly paid by Roland Hazard of the town of South Kingstown County of 112 the said Rowland Hazard, or order, three years from date with interest at the rate of seven per cent per annum payable semiannually. — Now therefore, I of the said William H. Tucker, or my heirs, Executors, Administrators or assigns, or any other person, for me or for them shall pay said note at maturity, together with the interest thereon according to the tenor thereof, then the deed shall be void otherwise shall be and remain in full force and effect. Furthermore, I the said William H. Tucker do hereby constitute and appoint the said Rowland Hazard, his executors, Administrators and assigns, my Attorneys irrevocable with full power of substitution and revocation for me and in my name or in their name or names at any time, in case default shall be made in the payment of said note or of the semiannual interest due thereon, or breach shall be made of the covenants of Insurance heretofore contained, and such default or breach shall continue for the term of ten days will to sell at Public Auction the premises aforesaid, or any part thereof. Said party first giving, after the expiration of said term of ten days twenty days notice of such Sale in some one of the public newspapers printed in Providence, and in his name or in their names, to make, execute, seal, acknowledge and deliver to the purchaser or purchasers thereof any deed or deeds that may be necessary to vest in such purchaser or purchasers a full and absolute estate in fee simple therein, and on sale thereof the hereby granting unto my said attorneys power to constitute and adjourn such sale further time to time, I do authorize my said attorneys to receive the amount for which the same may be sold for, and, after the payment of all the expenses incident to said sale, to apply and appropriate the con- sideration thereof to the payment of any principal of interest and any interest note hereby secured, I hereby agreeing that in case of a sale for default in the payment of said loan accrued interest, or for breach of said Cov- enants of Insurance, the principal of said note shall be deemed due and payable on the day of such sale,) accounting to me or my heirs or assigns, for all some and over and above the amount thereby recovering offsetting and confirming such sale or sales also may be made or caused to be made by written order. Furthermore, I the said William H. Tucker for myself and for my heirs writing, ex- ecutors and assigns, do hereby covenant with the said Rowland Hazard as to the premises that insurance against fire be and kept full and sufficient for the Buildings on the premises specified in the form now attached hereto and that the policy or policies of said insurance shall be assigned and transferred to the said Rowland Hazard as buyer and assignee as collateral security both, and in default thereof I do hereby agree that the said Rowland Hazard or assignee may effect said insurance, and the premium or premiums paid thereon shall be a further lien upon the said estate added to the amount of said note and secured by this Mortgage.
