We, HOWARD E. THORP and NELSON H. THORP, both of the Town of Westerly, County of Washington and State of Rhode Island, for consideration paid grant to ROGERS E. TRAINER and FLORENCE T. TRAINER, husband and wife, both of the Town of Westerly, County of Washington and State of Rhode Island, as joint tenants and not tenants in common, meaning to the survivor, with WARRANTY COVENANTS. A certain tract or parcel of land situated and located at Quonsetconquut Beach, so called, in the Town of Charlestown, County of Washington and State of Rhode Island, lands and premises described as follows: to wit: Beginning at a point on the westerly side of a driveway in Ninigret Avenue, so called, said point being marked by a drill hole in a rock and being the north easterly corner of the parcel of land conveyed, et ux there westerly advance at right angles to the westerly line of Ninigret Avenue one hundred forty feet (140 feet) to the northeasterly corner of the parcel of land conveyed; then turning a right angle and extending southerly one hundred sevenen and thirty one hundredths (107.31) feet to the northeasterly corner of the parcel of land herein conveyed, said point also being the northeasterly corner of the land of William G. Sayer, et ux there northeasterly one hundred forty-five (145) feet, more or less to the southeasterly corner of the parcel of land conveyed in a deed to the westerly line of Ninigret Avenue; thence northerly along a curve marking the westerly line of said Avenue one hundred forty-one (141) feet to the point of place of beginning. Bounded easterly by Ninigret Avenue, northerly by the land of James E. Zondberg, et ux westerly by the other lands of these grantors and southerly by the land of William G. Sayer. Meaning and intending to convey Lot #25 as shown and delineated on a certain record copy of a map entitled, "Plat of Quonsetconquut Beach centered at extending south, Parcel 4, 1944, as owned, property of E. H. and N. H. Thorp, scale 1 inch equals 80 feet, July, 1948, Rossi & Lewis, Engrs." Said grantees, their heirs and assigns shall have the right to pass, and repair to and from the road and beach, on foot or other vehicles, over and across certain rights of way or roads as shown on the above mentioned plat and also on the separate plat showing "Quonsetconquut Beach" centered at extending south, dated 1924, resubmitted September 10, 1929, leading to the beach and also the right of way leading from the beach to the street whatever public road may hereafter be designated for public use; the said grantees, for themselves, their heirs and assigns hereby covenant and agree to and with the said grantors, their heirs and assigns, that the said

170 grantees, their heirs and assigns will and shall pay to Quonsetcounting Central Beach Fire District its successors and assigns, on or before the first day of August in each year hereafter the sum of Five (5) Dollars for each lot hereby conveyed; said sum to be expressed and supplied by the said Quonsetcounting Central Beach Fire District, its successors and assigns in its annual and unrestricted contribution to the disaster and aid maintenance of the district for purposes that may be designated for public use, and the said sums agreed to be paid are hereby made a lien and charge upon the premises hereby conveyed and in case of failure to make any payment within one year after the same shall become due, it shall be lawful for the said Quonsetcounting Central Beach Fire District, its successors and assigns to sell and convey the same premises at public auction, first giving notice of such sale in a newspaper of general publication in said County for two weeks, and to cause such a week for three successive weeks, and to make the purchase or purchasers a deed subject to the following conditions and restrictions, NAMELY: 1. In case of a contemplated sale of said lot or parcel of land or any part thereof, Howard E. Thorp and Nelson H. Thorp, their heirs and assigns, shall be given ten days notice in writing and shall have the first option to purchase the same at a price equal to the improvements thereon at the highest bona fide price in good faith made and actually offered to the said grantees, their heirs and assigns. 2.
