FENELON and PAULINE E. FENELON, husband and wife, both of the Town of Hopkinton, County of Washington and State of Rhode Island, as joint tenants and not tenants in common, meaning to the same survivor with WARRANTY Acres, plat of Charlestown Estate, Book II," Quonochontaug, Charlestown, R.I., scale 1 inch equal 80 feet, instrument recorded in the land Evidence records of the said plat being recorded in the Land THORP and NELSON H. THORP, both of the Town of Westerly, County of Washington and State of Rhode Island, hereinafter called the grantors, for consideration paid grant to EDNA REEVES ROWLEY, of the City of Flushing, County of Queens and State of New York, hereinafter called the grantee, with WARRANTY COVENANTS. Those certain two tracts or parcels of land situated and lying on the northerly side of Newport Avenue in the Town of Charlestown, at Quonocutaug Beach in the Town of Charlestown, County of Washington and State of Rhode Island, described as follows: Lots #148 and #150 as shown on a certain plan or plat entitled "Plat of Quonocutaug Beach, Charlestown, RI, February, 1942," Charlestown, R. I., said lots being 60 feet wide and 120 feet deep, surveyed by Rossi & Lewis, Engrs. said plan or plat being on file in the Town Clerk's Office of said Town of Charlestown, R. I. said Lots #148 and #150 consist of one hundred thirty (130) feet on Neptune Avenue, and are one hundred twenty feet (120 feet in depth. They are bounded northerly by other lots of these grantors, easterly by Lot #149, westerly by Lot #147, and southerly by Neptune Avenue, so called, and westerly by said Raymond W. Semans, et ux. Said grantees, her heirs and assigns shall have the right to pass and repass to and from the said lots and parcels of land over and across one or more roads and across those certain rights of way or roads as shown on the above mentioned plat and also on the plat referred to in said title, "Quonocutaug Beach, Charlestown, RI," dated October, 24, 1924, revised September 10, 1929, leading to the beach and also the plat referred to in a deed to said grantee, recorded in the land evidence books of said Town, and any other portions of said plats which might not hereafter be designated for public use and the said grantors, their heirs and assigns, will not make or execute any covenant and agree to and with the said grantees, their heirs and assigns, that the said grantees, their heirs and assigns, will not interfere with the use of the roads before the day of August 1st, 1965, conveyed said sum is to be expended and applied for each lot in the above conveyed, said sum is to be expended and applied by said Quonocutaug Central Beach Fire District, its successors and assigns, on the construction and maintenance of roads and other portions that may be designated for public use, and the said sums are to be paid in full as a one time and charge upon the said lots and parcels hereby conveyed, and in case of failure to make any payment within one year after the same is due and payable, the said grantors, their heirs and assigns, and the said Quonocutaug Central Beach Fire District, its successors and assigns, to sell and convey the premises in said Town of Charlestown, R. I. after notice of such sale is given by advertisement in a newspaper published in said County of Washington, at least once a week for three consecutive weeks prior to the date of such sale. This conveyance is made and accepted subject and subordinate to the following conditions and restrictions, NAMELY: 1. In case of a contemplated sale of said lot or parcel of land or any part thereof, Howard B. Thorp and Nelson H. Thorp, their heirs and assigns, shall be given ten days notice in writing and shall have the first option to purchase same with the said notice and agreement thereon at the highest bona fide price in good faith made and actually offered to the said grantee, her heirs and assigns.
