215 STATUTORY FORM OF WARRANTY DEED CHARLESTOWN ESTATES, INC., a corporation duly incorporated under the laws of the State of Rhode Island and having a place of business in the Town of Westerly, County of Washington and State of Rhode Island, for consideration paid grant to JOHN DOUGLAS and MARION K. DOUGLAS, husband and wife, both of the Town of Westerly, County of Washington and State of Rhode Island, as joint tenants and not tenants in common, meaning to the survivor with WARRANTY COVENANTS. That certain tract or parcel of land located on the westerly side of Highland Road, so called at Quonocutaug Beach in the Town of Charlestown, County of Washington, and State of Rhode Island, more or less, and described as follows: Lot #40 as shown and delineated on a certain plan or plat entitled "Plat of East Beach, Quonocutaug, R. I., Property of S. H. Davis, Inc." Leon H. Holland, C. E., Says 1 inch equals 100 feet, Revised July, 1935, Charlestown. Said plat being duly filed in the Land Evidence Records of Charlestown. Said lot #40 contains one 1/4 ripy (50 feet) West in and extends one hundred twenty-five (125 feet) in depth. In consideration of the purchase price it is understood and agreed that the following restrictions and reservations shall apply to and run with the land for a period of twenty years from the date hereof: The above conveyed premises shall be used as a site for only one residence. Said residence to be of a class to cost not less than one thousand ($1000) dollars, to be built in accordance with the building line determined by the town of Charlestown; the side lines of the building shall be set back 20 feet from the street line; no portion of the building shall approach the street line closer than 20 feet, nor shall any building side line and no portion and any of building erected on this lot shall approach the side line of the lot closer than 20 feet, no garage or other out buildings or buildings shall be erected thereon and all toilets must be sanitary toilets; septic tanks or toilets and sinks means drain to a septic tank or suitable cesspool. The grantees, their heirs, successors, administrators, executors, assigns, licensees, servants or agents shall have the right in common with others to cross over and across Lot #40 as shown on said plat from Atlantic Avenue to the beach; and the grantees, their heirs, successors, administrators, executors, assigns, licensees, servants or agents shall have the right in common with others to cross over and across Lot #40 for all purposes over that certain lot #38 to Charlestown Pond as shown on said plat and the above-tive for said purpose and to use the highway to said lot.
