42 LEASE
This INDENTURE, made this 29 day of March, 1952, between FRANK I. STORIN and
HELEN W. STORIN, of the City of Pawtucket, County of Providence and State of Rhode Island,
party of the first part, and DOROTHEA D. WALSH, of the Town of Charlestown, County of
Washington and State of Rhode Island, party of the second part.
FIRST: That the said party of the first part doth hereby lease and demise unto
the said party of the second part:
That certain parcel of land described as a certain tract or parcel
of land, situated on Charlestown Beach Road, in said Town of Charles-
town, and designated and described in the 1st Records of Assessors
as Plat 13 lot 35 p 310 which for a more particular description, re-
ference is hereby made and is made a part hereof,
for a term of 5 years, from the 1st day of April, 1952, at the yearly rental of $150.00,
payable in advance.
SECOND: The party of the second part agrees that should the said premises be
assessed for taxation at a higher rate than they are assessed at the present time, on
account of the erection of the bathing establishment and other improvements which the
party of the second part proposes to make in the said premises, the difference in the
amount between the taxes as they now are, and what they will be at the higher assessed
value shall be paid by the party of the second part annually during the term of this
lease.
THIRD: That the party of the second part will not sell or assign this lease or
sublet said premises or any part thereof without first obtaining the written consent of
the party of the first part.
FOURTH: The party of the second part shall assume all liability and damages
which may arise from any accident which may occur on said premises.
FIFTH: At the expiration of this lease, the party of the second part agrees
that the party of the first part shall have the right to enter into and upon the land,
and repossess themselves thereof, and that all improvements of whatever kind and nature
erected upon said land during the life of this lease shall revert to the party of the
first part and become their property in fee simple without process of law.
SIXTH: It is further agreed that if, during the term of this lease, the party of
the first part, their heirs or assigns, should desire to sell said demised premises, then
the party of the second part, her executors, administrators or assigns, shall have the priv-
ilege of purchasing the same for the same price for which the party of the first part would
be willing to sell to any other person; but if the party of the second part, her executors,
administrators, or assigns, shall not exercise said option of purchase within ten days
after notice in writing from the party of the first part, their heirs or assigns, of such
desire to sell, then this lease shall be and become void upon a conveyance of said demised
premises by the party of the first part, their heirs or assigns.
SEVENTH: And it is further agreed that the covenants and agreements herein contained
are binding on the parties hereto and their legal representatives.
IN WITNESS WHEREOF, we have hereunto set our hands and seals, the day and year first
above written.
