395 NOTICE OF LEASE Statement substantiating the terms of an oral lease. This will substantiate the fact that George H. and Rufus K. Prosser; hereinafter called the lessors, have agreed to lease the tillable land on their farm in Charlestown, Rhode Island to E. E. H. and T. W. Browning, hereinafter called the lessees, together with the pasture in the southern section of the farm for a sum amounting to three-hundred ($300.00) dollars above the 1941 tax levies upon the land (not buildings) of that farm; also, tillable land in Corn Crib lot. Furthermore, the lessees are to have the use of the barn cellar upon the premises for a sum amounting to the present premium of insurance on that building plus the 1941 tax on the same. However if the amount of this tax cannot otherwise be determined, then it is agreed to be an amount equal to one half the total tax on all the buildings on these premises. It is agreed the lease will run for one year beginning Apr 1 1941 and will continue from year to year except as otherwise provided by the parties. It is also agreed that should the lessors not desire to continue to lease for any additional period, that they will notify the lessees on or before September 1, 1941. It is further agreed that should such notice be given, the lessors will have a right to sow a cover crop upon the land at any time after the leaseses potato crop has been harvested. Likewise, it is agreed that if the lessees do not desire to continue the lease for an additional term that they will notify the lessors on or before September 1, 1941, and should such notice be given, the lessors will have a right to sow a cover crop upon the land at any time after the leaseses potato crop has been harvested. Moreover, it is agreed that if no notice be given by either party on or before September 1, 1941, then this fact will be interpreted by the parties to mean that the lessors and lessees agree to lease for an additional year, at the same terms, with the exception that the 1942 tax assessments will be used and notice to terminate or continue the lease will be given on or before September 1, 1942. In such case, where no notice is given by either party, the lessees will have a right to sow a cover crop for the next seasons planting. It is agreed that all hunting rights as reserved and enjoyed by the grantors in the past are reserved solely to the grantors in this lease. Dated Nov 1 1940 RUFUS K. PROSSER GEORGE H.
