101 WARRANTY DEED We, EVERETT R. GRAICHEN and wife, LUCY GRAICHEN, both of the City and County of Providence, in the State of Rhode Island for the consideration paid, grant to IRVING HAROLD CRANDALL and wife, ARLENE BLIVEN CRANDALL, both of the Town of Westerly, County of Washington, in the State of Rhode Island as Joint Tenants and not as Tenants in Common, with WARRANTY COVENANTS excepting as hereinafter mentioned restrictions. That certain lot or parcel of land situated in the Town of Charlestown, in the County of Washington, St. of Rhode Island, laid out and described as Lot No. 4 on the plat entitled "Lot 4 enterpise [?] No. 1 Shady Harbor, Charlestown, R. I." Belonging to Everett Graichen & Sydney Cohn, certified R. Sturtevant, Surveyor, May 11, 1936 which plat is recorded in the office of the Town Clerk of the Town of Charlestown in the Plat Book No. 2. Said lot is conveyed subject to the following restrictions: 1. No trailer, tent, basement a concrete Hut, mach shed, or temporary buildings may be placed on said land. 2. The parcel land shall be used exclusively only for residential purposes. 3. No outside toilet shall be erected on the premises, nor shall any signs advertising purposes be placed, erected, or maintained on the premises, nor shall any signs be removed or altered until the plans be approved in writing by the heirs, devisees, assignees, or owners of the surrounding lots. 4. Each house must have a full foundation, said house to be at least 22 feet by 24 feet, nor including its trailer, balcony, or porch. 5. No livestock, such as horses, sheep, pigs, chickens, animals or poultry set kept on the premises, other than household pets. 6. Ten cents (10c) per lot per year (or $3.00 per year) shall be paid as a maintenance assessment to be paid for the maintenance of roads and general improvement of said plat. Said assessment is formed for the purpose of this function. 8. All structures must comply with municipal and government laws, ordinances and regulations; however thereby it shall not be construed as a waiver by the Grantors of compliance with such laws ordinances and regulations. 9. No fence higher than thirty (30) inches shall be erected or maintained on the premises. And I, SYDNEY COHN, of the City of Cranston, County of Providence, in the State of Rhode Island, mortgage named therein in that certain mortgage said eveyett R. GRAICHEN and wife, Lucy Graichen to said Sydney Cohn, recorded in said office in Real Estate Mortgage Book 33 at page 332 on November 22, 1952, and in consideration of the sum Ten ($10.00) Dollars and o other valuable consideration to me paid, the receipt whereof is hereby acknowledged, do hereby remise, release and forever quitclaim unto the said IRVING HAROLD CRANDALL and wife, ARLENE BLIVEN CRANDALL as Joint Tenants and not as Tenants in Common, their heirs and assigns forever, all the right, title, interest, property, claim and demand which I now have or of right ought to have or claim in and to the aforesaid described premises, by virtue of said mortgage. It is distinctly understood that the foregoing release by me, the said Sydney Cohn, shall in no way affect or impair my right to hold under my mortgage said and security for the sum remaining due thereon or to sell under the power of sale therein contained, or otherwise to enforce the provisions thereof against all the remaining premises now subject to said mortgage and not released hereby. And we, EVERETT R. GRAICHEN and wife, LUCY GRAICHEN, do hereby release all our rights of Courtesy and Dowrer, and all other right, title and interest, in the aforesaid described premises.
