619 We, WILLIAM MARTIN BRITTON and ROSELLA D. BRITTON, husband and wife, both the city of Springfield, County of Hampden and State of Massachusetts, as joint tenants, for consideration paid, grant to THOMAS E. PRESCOTT and MABEL E. PRESCOTT, husband and wife, both of Passaic, County of Passaic and State of New Jersey, as Joint Tenants and not tenants in common, meaning to the grantor, with warranty covenant, as follows: A certain tract or parcel of land located on the easterly side of Midland Road, so called, at Quonutaug Beach, in the town of Charlestown, County of Washington and State of Rhode Island, and bounded and described as follows: Beginning at an iron pipe driven in the ground at the northerly corner of the premises hereby conveyed; thence extending in an easterly direction 155 feet, more or less, to an iron pipe driven in the ground at the northeasterly corner of the premises hereby conveyed; thence turning an angle of 90 degrees and extending in a southerly direction 60 feet to the southeasterly corner of the premises hereby conveyed; thence turning an angle of 90 degrees and extending in a westerly direction 155 feet to an iron pipe driven in the ground at the southwesterly corner of the premises hereby conveyed; thence turning an angle and extending in a northerly direction extending along the easterly line of Midland Road, so called, to the point of beginning; the said land being bounded easterly by Midland Road; northerly by the land of Joseph de Grantore, and wife; southerly by the land of Joseph de Grantore, and wife; and westerly by the land of Charlestown Estate, Inc. Meaning and intending to convey lot number #291 as shown and delineated on a certain plan or plat entitled of Quonutaug Beach Shipgrounds at Quonutaug Beach, Rhode Island, property of S. H. Davis, Leon L. Holland, C. E. 100 feet to the inch, February, 1926." Said plat being duly filed in the town clerk's office, the land hereby conveyed is subject to the following restrictions: that said land shall be used as a site for only one residence on the lot hereby conveyed, said residence to be of a class to conform to the character of the neighborhood in which it is located; that no building or structure, which is 20 feet from the street line of Midland Road, no portion of the house, (porch including) shall extend street ward nearer than said building line, no portion of any building or building erected on the lot shall approach the street line nearer than 20 feet; that no building larger than detached garage or other building or buildings shall be erected thereon and all toilets must be sanitary flush toilets and all sewers and pipes must drain into some septic tank or similar suitable cesspool. In consideration of the grant of the premises and as a further inducement and agree that of the above restrictions and regulations shall apply to and run with the land for a period of ten years from the date of delivery September 1st, 1945. The grantees, their heirs, executors, administrators, assigns, licensees, servants or agents of shall have the right in common with the others to cross over and across lot No. 489 from Atlantic Avenue to the beach; and the grantees, their heirs, executors, administrators, assigns, licensees, servants or agents shall have the right in common with the others to cross over and across lot No. 489 and for all purposes over that certain lot No. 538 and the 25 foot right of way leading to said lot, as shown on the plan of Quonutaug Beach Shipgrounds at Quonutaug Beach, Rhode Island, property of S. H. Davis, Inc., Leon L. Holland, C. E. Scale 1 inch equals 100 feet Revised July, 1931." Which plat is duly filed in the Land Evidence Records of said Town of Charlestown.
