September 1855 In presence of C. Holden Charles Cross Potter Hoxsie L.S. Washington Co Charleston town Sept 1st 1855. personally appeared Potter Hoxsie and acknowledged the foregoing instrument by him signed to be his free and voluntary act Before Me Charles Cross J.P. Recorded Sept 1st 1855 By Chas Cross Clerk This indenture made the first day of December in this year one thousand eight hundred and fifty four, between Benjamin York of the Town of Westerly County of Washington and State of Rhode Island of the First part and Samuel Saunders of the same County County and State of Rhode Island of the Second part Witnesseth that the said Benjamin York of the first part here in and consideration of the sum of five dollars lawful Money of the United States of America to be paid in hand paid by the said party of the second part or of before the use and delivery of these presents the receipt whereof is hereby acknowledged has granted bargained Sold all and remised released conveyed and confirmed and by these presents does grant bargain sell all and remise release convey and confirm unto the said party of the second part and to his Heirs Devisees and Assigns forever the whole half part of a certain tract of Marsh Land lying and being in Charlestown in the County and State aforesaid and bounded and closed as follows Fourteenth on the East Close and westerly on Land of Joseph Guy Taylor Northerly on a creek or Breach Castley and South bounded to the First part mentioned above together with all and appurtenances thereunto belonging including the improvements thereon belonging in as species office offering bakery the scullery and pheripheries remainder and remainders heritages issues and profits thereof And also all the estate right title in and interest Portanto Hoxsie claim and demand whatever as well as to have and to enjoy the said party of the first part for ever or to the above described premises and every part and parcel thereof with the appurtenances And to have and to hold all and singular the above mentioned and described premises together with the appurtenances unto the said party of the second part the First part and his Heirs the said party of the first part and his Heirs the said premises in the quiet and peaceable Possession of the said party of the second part his Heirs and Assigns against the said party of the first part his Heirs and Assigns against all and every person and persons whomsoever lawfully claiming or to claim the same Shall and will warrant and by these present forever defend In Witness whereof the said party of the first part has set his Seal and delivered Benjamin York L.S.
