Charlestown December Third 1841 Personally came before Me the return named person Silas James and declared again the within written Indenture by him signed to be his free and voluntary act and deed Signed at the hands of Silas Deliverance Ann James bonded Wife of the said Silas James after hearing the said Indenture explained to her by me she declared and spoke free from her husband's coercion acknowledging the same to be her voluntary act and deed and from error without duress with wish to convey Charlestown Dec 3rd 1841 Before me Wm Thornton few clerk. By Philistine P. clerk. Know all men by these presents that I John E Smith of Charlestown in the county of Washington state and State of Rhode Island and his P. Smith wife of the said John E Smith & smith on consideration of the sum of one hundred dollars paid me by Mason Brown of town of Charlestown thereunto the receipt whereof as to receive ratifiedly to hereby remise release and forever quit claim unto the said Mason Brown his heirs and assigns forever the whole part of a certain undivided third part of land lying in delivery Ward Mason bordering bordering on Charlestown aforesaid containing by estimation five Twenty rods east by the same more or less and bounded as followed south easterly by road publicly and Elderly of north and Middle road Middle road on North eastly and Easterly land of Mason Middle road on South westly land of house bounded broken lands Also my whole part of a certain undivided third part of land lying in situated on east Charlestown containing by estimation five poles bounded East between more or less Standard at field corner [illegible] on the diagonal side some yards and from there North easterly and Northly on a road leading to house otherwise bounded and limited with my part of a certain undivided third part of land lying on the town line Charlestown and containing by estimation five poles bounded East between the town line and bounded on south easterly by road publicly or lines of Bridge road Northly on land of George Bard and others Northly on the Diagonal side and bounded on the town line John Brown & others bounded Northly on the house whereas named lot of landing belonging to limited in some laws land of house Mason Brown and on the whole portion by virtue of a deed of a lease by lease by lease Mason Brown of the said Smith Smith. I have also to Not the home together with all the Privileges and appurtenances named hereof in some part Mason Brown his heirs and assigns forever and in such John E Smith and his wife Mary M. Smith in order’s write I do hereby convey and convey her Hereditaments and Administrations to convey with the land to the said Mason Brown and assigns Also that we will warrant and defend the home to the said Mason Brown his heirs and assigns forever against the claims Terms of all persons claiming by marriage or under me according to the terms of this deed’s the aforesaid Cohabited Lease further PROMISE under our hands and seals this 28th day of October 1841.
